This paper describes the concept of an EU patent ant the course of attempts which led to its creation. Furthermore, it introduces regulations which have been made during the process of the harmonization of patent law in the EU. It also describes issues associated with work on the EU patent such as the European patent litigation system ant the solutions litigation system and the solutions proposed in the translation of the patent. Moreover, the thesis depicts the consequences of the maintenance of the national patent systems for the EU, and shows that the solutions applied within the EPO are insufficient and are not able to eliminate the repercussions.

Niniejsza praca opisuje koncepcje i przebieg prób utworzenia patentu unijnego. Przybliża również regulacje, jakie zostały dokonane w ramach prac nad harmonizacją prawa patentowego w obszarze UE. Opisuje również zagadnienia towarzyszące pracom nad patentem UE takim jak : europejski system sądownictwa patentowego oraz rozwiązania proponowane w zakresie tłumaczeń związanych z patentem unijnym. Pokazuje też, jakie konsekwencje w ramach UE płyną z utrzymywania krajowych systemów patentowych oraz pokazuje, że nawet rozwiązania w ramach EPO ich nie eliminują i nie są wystarczające.
