W niniejszym artykule dokonano analizy rozporządzenia Parlamentu Europejskiego i Rady (UE) nr 1285/2013 z dnia 11 grudnia 2013 r. w sprawie realizacji i eksploatacji europejskich systemów nawigacji satelitarnej w świetle zobowiązań państw członkowskich UE wynikających z umów międzynarodowych z zakresu ochrony praw człowieka. Analiza została poświęcona prawu do życia, prawu do prywatności, a także prawu do skutecznego środka odwoławczego i klauzuli antydyskryminacyjnej. Potwierdzona została teza stanowiąca o istnieniu ścisłej relacji pomiędzy europejskim system nawigacji satelitarnej a wspomnianymi prawami. Za najważniejsze z omówionych zagadnień należy uznać: wpływ Galileo na realizację zobowiązań z zakresu ochrony życia, zagrożenia związane z użytkowaniem europejskiego systemu nawigacji satelitarnej dla ochrony prywatności i danych osobowych oraz brak regulacji pozwalających na dochodzenie przez jednostkę odszkodowania w sytuacji nieprawidłowego funkcjonowania sygnału Galileo. W artykule wskazano, że przyszłe ramy prawne funkcjonowania Galileo powinny zawierać regulacje, które w sposób szczególny uwzględniać będą ochronę prawa do prywatności, w tym ochronę danych osobowych, oraz prawo do skutecznego środka odwoławczego. |

The present paper is about the European satellite navigation system and its relation with human rights, particularly with the right to life and right to privacy, right to effective remedy and the anti-discrimination clause. It examines whether the legal framework of the European satellite navigation system is in line with the instruments of human rights protection, such as the International Covenant on Civil and Political Rights (ICCPR), the Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) to which all EU Member States are parties, along with appropriate European Union law, including the Charter of Fundamental Rights of the European Union (Charter). The article describes the legal framework of human rights treaties and analyses Regulation (EU) No 1285/2013 of the European Parliament and of the Council of 11 December 2013 on the implementation and exploitation of European satellite navigation systems and repealing Council Regulation (EC) No 876/2002 and Regulation (EC) No 683/2008 of the European Parliament and of the Council in the light of human rights obligations. The main hypothesis seeks to demonstrate that it can indeed be confirmed that there is a clear relation between human rights and the European satellite navigation system and that the legal framework of this system in the future should be constructed with all necessary regard for human rights norms, which are binding not only on the EU itself but also on individual Member States of the EU as well, in order to avoid any further legal claims against them. The paper also attempts to deal with the difficult questions how the European satellite navigation system can support the state in its discharge of the obligation to protect life and how its use can lead to infringements of the right to privacy, as well as the lack of solutions concerning responsibility for interruption of Galileo signals. |
