Opracowanie poświęcone jest analizie znaczenia, zakresu oraz charakteru prawnego praw społecznych uwzględnionych w Karcie Praw Podstawowych UE. Autor podkreśla, że godność człowieka stanowi punkt wyjścia dla uregulowania praw fundamentalnych. Przedstawia konkretne uprawnienia, szczególną uwagę poświęcając prawom zamieszczonym w Tytule IV „Solidarność”. Podkreśla, że Karta Praw Podstawowych wprowadza nową jakość w dziedzinie praw społecznych gwarantowanych prawem unijnym. Analizuje charakter prawny poszczególnych praw społecznych, a także podkreśla znaczenie Karty dla działalności legislacyjnej Unii Europejskiej. Sprzeciwia się poglądowi, że Karta sama w sobie uniemożliwia ograniczanie zakresu ochrony praw społecznych na poziomie krajowym. Argumentuje również, że ich zakres podmiotowy powinien być szeroki, a uprawnienia pracownicze powinny obejmować osoby świadczące pracę podporządkowaną na innych podstawach prawnych niż stosunek pracy. Autor przedstawia również konsekwencje protokołu – polsko brytyjskiego dla statusu praw społecznych w Polsce.
abstract in English:
The elaboration is dedicated to the analysis of the importance, scope and legal character of social rights recognized in the EU Charter of Fundamental Rights. Author enhances dignity as starting point for introducing fundamental rights. Particular social rights are presented, with special regard to the Title IV “Solidarity”. The innovative character of social rights recognized by Union law and added value of the Charter are stressed. Author analyzes the legal character of particular social rights and enhances the importance of the Charter for legislative competences of the European Union. Author opposes the non – regression clause. He also argues for a broad personal scope of application of social rights. In his opinion particular rights should cover not only employees, but also workers who perform subordinated work under legal relationships other than an employment contract. Author analyses also the Polish – British Protocol and its consequences for status of social rights in Poland.
