The influence of matrimonial property regime on legal effectiveness of disposing transaction of shares in Polish real estate in Austria : some remarks on District Court decision (Land and Mortgage Register Department in Gostynin of 31th January 2014)
Article analyses the influence of usage of different languages and different legal rules on the scope of practical applications of bilateral agreement on civil aid between Austria and Poland. Because of fundamental differences among legal rules concerning a basic matrimonial property regime (in Austria the legal matrimonial property regime means separation of property, in Poland it is the community of property, this regime can be modified by a marriage contract in order to establish the separation of property regime), some institutions in transactions can be provided differently and they can have different consequences in practice. Court decision analysed in this article is an example of the solution of the problems arising in bilateral agreement application.
