Legal status of local councils

Niniejsza praca magisterska porusza zagadnienia związane z wykonywaniem funkcji radnych w gminie. Rozdział pierwszy zawiera informacje dotyczące samorządu terytorialnego, a w szczególności gminy, jako jednostki będącej w bezpośrednim kontakcie z obywatelem. Główne zagadnienia, jakie zostały poruszone w tej części pracy ukierunkowane są na opis organów, a także podstawowych informacji dotyczących radnych-członków rady gminy a zarazem przedstawicieli społeczeństwa we władzach samorządowych. Opis procedury wyboru na stanowisko radnego zamyka rozważania pierwszego rozdziału. W następnej kolejności przybliżony został wolny charakter mandatu przedstawicielskiego, a co za tym idzie cała procedura jego uzyskania a także przywileje związane z sądową ochroną owego mandatu. Rozdział drugi zawiera również opis pracy radnego a więc jego stabilność i brak możliwości odwołania z pełnionej funkcji. W rozdziale trzecim przedstawiono podział i obowiązków radnego ze względu na piastowanie przez niego funkcji przedstawiciela społeczności lokalnej oraz członka organu stanowiącego gminę. Zagadnienia obejmujące wygaśnięcie mandatu radnego wraz z procedurą stwierdzenia owego wygaśnięcia umieszczono w rozdziale czwartym. Porównanie statutu radnych na przykładzie dwóch gmin Andrychów i Kraków zamyka rozważania tematu pracy.

This thesis discusses the issues associated with the duties of councilors in the municipality. The first chapter provides information on local government, particularly municipalities, as individuals being in direct contact with the citizen. The main issues that have been raised in this part of the work are focused on the description of bodies, as well as basic information concerning councilors and members of the municipal council at the same time society representatives in the local government. Description of the selection procedure for the post of councilor closes the first chapter considerations. In the next multiple destinations has been slow nature of the mandate of a representative, and thus the whole procedure of obtaining and privileges associated with judicial protection of that mandate. The second chapter also describes the job of councilor and hence its stability and the impossibility of dismissal from a function. The third chapter presents the classification and duties of councilor due to hold the by him as a representative of the local community and member of the legislative body of the municipality. Issues involving the expiry of the mandate of the councilor with the procedure expiry of that statement was placed in chapter four. Comparison of the Statute of the councilors on the example of two municipalities Andrychów and Krakow closes the topic of discussion.
