The Withdrawal from the mistakenly taken therapy - inaction and withdrawal from persistent and futile treatment

Praca zatytułowana „Odstąpienie od błędnie podjętej terapii – niepodejmowanie i wycofanie się z terapii uporczywej i daremnej” dotyczy współczesnego problemu medycyny - zagadnienia rezygnacji przez lekarza z niektórych grup terapii. Pierwsza część pracy sprowadza się do zebrania i wyjaśnienia pojęć, które są kluczowe dla dalszych rozważań tj. „odstąpienia”, „terapii” oraz „błędności”. Następnie analizie poddana została problematyka uporczywej terapii na gruncie polskiego prawa. Opisane zostały konsekwencje prowadzenia uporczywej terapii, które poprzedziły rozważania na temat pojęcia uporczywej terapii, unormowań konstytucyjnych zagadnienia. Kolejno analizie poddana została możliwość i skutki prawne odstąpienia od terapii daremnej, której definicja projektująca została stworzona na potrzeby pracy.Z uwagi na brak uregulowania tematyki w przepisach powszechnie obowiązującego prawa, za konieczne uznano postawienie postulatów de lege ferenda. W pracy oprócz interpretacji obecnego stanu prawnego powołano się na poglądy doktryny, orzeczenia zagranicznych sądów, osądy moralne.

The thesis entitled " The Withdrawal from the mistakenly taken therapy - inaction and withdrawal from persistent and futile treatment " refers to the contemporary problem of medicine - the issue of resignation by a doctor from some treatment groups. The first part of the thesis is about gathering and clarifying the notions that are crucial for further considerations - that is "withdrawal", "therapy" and "fallacy". Then, the analysis covers the issue of the persistent treatment on the basis of Polish law. Furthermore, the thesis describes the consequences of the persistent conduct therapy, which is preceded by the discussion on the concept of persistent therapy and constitutional normalization of the issue. Respectively the author makes an analysis of the opportunity and the legal consequences of the withdrawal of futile therapies , of which the definition has been created for the needs of the thesis.Due to the lack of regulations of the subject in the existing legal regulations, it was necessary to place demands de lege ferenda. The views of doctrine, the judgments of the foreign courts, the moral judgments are also visible in the thesis next to the interpretation of the existing legal status.
