Legal conditions in the sphere of psychological aspects of patient-doctor relationship.

W niniejszej pracy magisterskiej omówione zostały psychologiczne aspekty relacji lekarza z pacjentem oraz prawne uwarunkowania owych aspektów. Przedstawiona została charakterystyka zarówno psychologicznej jak i formalnej sytuacji pacjenta oraz główne problemy jakie występują w jego relacji z lekarzem. Okazało się, że relacja ta, może być poprawna i efektywna, ale wymaga to dobrej woli obu stron, przede wszystkim jednak lekarza, który powinien wykazywać się partnerską postawą w stosunku do pacjenta. W polskim prawie, istnieją zapisy dotyczące ochrony psychicznej pacjentów, którzy mają prawo do skorzystania z pomocy psychologicznej i psychiatrycznej. Działania te, przede wszystkim mają być podejmowane wobec dzieci, młodzieży, osób starszych oraz osób, które znajdują się w sytuacjach stwarzających zagrożenie dla ich zdrowia psychicznego. Lekarz, jako osoba wykonująca pracę narażoną na silny stres i wypalenie zawodowe (co zostało udowodnione na kartach pracy – lekarze dużo częściej niż reszta populacji wykazują przypadki stresu, wypalenia zawodowego, depresji a nawet częściej popełniają samobójstwa) nie może liczyć w tej kwestii na żadne szczególne traktowanie, które byłoby unormowane prawnie. Lekarze, są w tej kwestii traktowani są tak samo jak inni obywatele, którym przysługuje opieka psychologiczna na mocy przepisów polskiego prawa. Niniejsza praca została napisana w oparciu o pozycje bibliograficzne polskich autorów dotyczące relacji lekarza z pacjentem oraz na postawie obowiązujących w Polsce aktów prawnych.

This thesis discusses the psychological aspects of the doctor's relationship with the patient and the legal context of these aspects. This master thesis presents the characteristics of both the psychological and the formal situation of the patient and the main problems that occur in his relation with a doctor. It turned out that this relationship can be correct and effective, but it requires the good will of both parties, but above all the doctor who should show a partnership attitude towards the patient. In Polish law, there are provisions for the protection of patients who are entitled to psychological and psychiatric assistance. These actions are primarily aimed at children, adolescents, the elderly and people who are in situations that endanger their mental health. The doctor, as a person performing work exposed to severe stress and professional burnout (as evidenced - doctors more often show more cases of stress, professional burnout, depression or even suicide than any other population) cannot count on any special treatment that would be legally regulated. Doctors are treated in the same way as other citizens who are entitled to psychological care under Polish law.This work is based on bibliographical references of Polish authors concerning the relationship between the doctor and the patient and on the basis of legal acts in Poland.
