Direct application of the European Union’s law by Polish courts

Przedmiotem niniejszej pracy jest zagadnienie bezpośredniego stosowania prawa Unii Europejskiej przez sądy polskie. W pracy zostały przedstawione zarówno aspekty prawnomiędzynarodowe, jak i konstytucyjne. Znamiennym jest, iż wzrastająca rola Unii Europejskiej wywiera znaczący wpływ na kształt krajowych porządków prawnych. Przynależność do UE dla każdego z państw członkowskich rodzi problem konstytucyjny polegający na określeniu relacji zachodzącej między prawem krajowym a prawem unijnym. Decydująca rola w procesie ustalania właściwej limitacji pomiędzy dwoma elementami multicentrycznego porządku prawnego przypadła organom wymiaru sprawiedliwości. Nie tylko sądy powszechne, administracyjne, ale również Trybunał Konstytucyjny jawią się jako instytucjonalna gwarancja prymatu prawa UE oraz strażnik zadekretowanej konstytucyjnie otwartości polskiego systemu prawnego na prawodawstwo unijne.

The subject of this thesis is the issue of direct application of the European Union’s law by Polish courts. The author has described both legal and international aspects as well as constitutional ones. It is imperative to mention that the growing role of the European Union has much influence on the shape of national legal systems. For each member state, being part of the EU creates problems of constitutional nature, which are based on determining the relations between national and EU law. The deciding role in the process of establishing a correct limitation between the two elements of a multi-centric legal order has fallen into the hands of the judicial authorities. Not only common and administrative courts, but also the Constitutional Court is seen as an institutional guarantee of the primacy of the EU law and the guardian of the constitutionally declared openness of the Polish legal system towards the union’s legislation.
