Settlement of disputes before the Court of Arbitration for Sport

Tematem niniejszej pracy magisterskiej jest rozstrzyganie sporów przed Trybunałem Arbitrażowym do spraw Sportu.Praca składa się z czterech rozdziałów. W pierwszym z nich przedstawiono rys historyczny instytucji arbitrażu wraz z ukazaniem jego charakteru prawnego. Opisany został również jego podział oraz istotne cechy. Ponadto, w tym rozdziale zostały wskazane cechy sportu powodujące konieczność wyodrębnienia w nim arbitrażu, a także charakterystyka sporów sportowych oraz cechy samego arbitrażu sportowego.Drugi rozdział pracy poświęcono opisaniu procesu kształtowania się najważniejszego sądu polubownego w świecie sportu, czyli Trybunału Arbitrażowego do spraw Sportu. Przedstawiono także strukturę organizacyjną tej instytucji.W trzeciej części pracy skoncentrowano się na zagadnieniu jurysdykcji Trybunału Arbitrażowego do spraw Sportu. Najpierw opisano możliwości poddania sporu sportowego pod rozstrzygnięcie odpowiedniej instytucji arbitrażowej. Następnie wskazane zostało, jak przedstawia się jurysdykcja powyższego podmiotu w statutach międzynarodowych federacji sportowych. Dokonano także próby zobrazowania funkcjonowania Trybunału Arbitrażowego do spraw Sportu przy Polskim Komitecie Olimpijskim jako przykładu działania krajowego sądu polubownego. W ostatnim rozdziale dokładnie scharakteryzowano prowadzone przed Trybunałem Arbitrażowym do spraw Sportu postępowania, w tym zwykłe postępowanie arbitrażowe oraz postępowanie odwoławcze.

The subject of this master's thesis is settlement of disputes before the Court of Arbitration for Sport. The work consists of four chapters. The first of them presents the historical background of the institution of arbitration and its legal character. Its division and important features are also described. In addition, this chapter identifies the characteristics of sport that make it necessary to separate arbitration, as well as the characteristics of sports disputes and the characteristics of sports arbitration itself. The second chapter of the thesis is devoted to describing the process of formation of the most important arbitration court in the world of sport, the Court of Arbitration for Sport. The organisational structure of this institution is also presented.The third part of the thesis focuses on the issue of jurisdiction of the Court of Arbitration for Sport. First, the possibilities of submitting a sporting dispute to an appropriate arbitration body are described. Next, it was indicated how the jurisdiction of this entity is presented in the statutes of international sports federations. An attempt has also been made to illustrate the functioning of the Court of Arbitration for Sport at the Polish Olympic Committee as an example of a national arbitration court. The last chapter describes in detail the proceedings before the Court of Arbitration for Sport, including ordinary arbitration procedure and appeal arbitration procedure.
