Timeshare contract

Przedmiotem niniejszej pracy magisterskiej jest analiza ukształtowania umowy timeshare w oparciu o przepisy unijne oraz ustawodawstwo krajowe. W pracy omówiono historię instytucji timeshare w kontekście wieloletniego korzystania z domu, mieszkania lub innego obiektu wakacyjnego w Europie i Stanach Zjednoczonych. Omówione zostały źródła prawa stanowiącego podstawę regulacji umowy pomiędzy konsumentem a przedsiębiorcą w zakresie czasowego korzystania z miejsca zakwaterowania. Zaprezentowano możliwości ukształtowania umowy timeshare jako stosunku prawnego o charakterze zobowiązaniowym albo prawnorzeczowym. Szczególny nacisk został położony w pracy na zagadnienia dotyczące ochrony prawnej konsumenta przejawiającej się w jego uprawnieniach i skorelowanych z nimi obowiązkami przedsiębiorcy. Nakreślono formalne aspekty kontraktu timesharingowego. Przedstawione zostały również konstrukcje umów podobnych i powiązanych w postaci umów: o długoterminowy produkt wakacyjny, o uczestnictwo w systemie wymiany oraz pośrednictwa w odsprzedaży. Podsumowanie zawiera wnioski wynikające z przeprowadzonej analizy kontraktu będącego przedmiotem pracy, z uwzględnieniem postulatów de lege ferenda niezbędnych do zapewnienia pełnej ochrony praw konsumenta w związku z praktykami handlowymi mającymi na celu obejście przepisów unijnych i krajowych.

The subject of the thesis is the analysis of legal construction of timeshare contract on the basis of EU regulations and national legislation. The thesis discusses the history of timeshare institutions in the context of long-term use of a house, apartment, or other vacation property in Europe and the United States. The sources of law constituting the basis for regulating the contract between the consumer and the trader on temporary use of accommodation are discussed. Possibilities of forming timeshare contract as a legal relation of obligatory nature or property law are presented. Particular emphasis is placed on issues concerning legal protection of a consumers manifested in their rights and correlated with them obligations of an entrepreneur. The formal aspects of a timesharing contract are outlined. The constructs of similar and related contracts in the form of long-term holiday product, exchange participation and resale contrach are also presented. The summary contains conclusions resulting from the analysis of the contract being the subject of the study, including postulates de lege ferenda necessary to ensure full protection of consumer rights in connection with unfair business-to-consumer commercial practices aimed at circumventing EU and national regulations.
