Trafficking in human organs and trafficking in human beings on the territory of European countries in the light of public international law

Niniejsza praca jest przedstawieniem problemu handlu narządami w kontekście handlu ludźmi na terytorium państw europejskich w świetle prawa międzynarodowego publicznego. Składa się ona z czterech rozdziałów. Pierwszy z nich dotyczy handlu ludźmi, jego istoty oraz form i jest to wprowadzenie do dalszych części pracy. W drugim rozdziale znajduje się analiza pojęcia handlu narządami, porównanie go do pojęcia handlu ludźmi, a także przyczyny procederu i cele wykorzystywania uzyskanych z handlu narządów. Rozdział trzeci zatytułowany „Problemy związane z handlem narządami” zawiera analizę kwestii takich jak komercjalizacja ludzkiego ciała, turystyka transplantacyjna, przestępczość zorganizowana czy pojęcie ofiary w odniesieniu do tego czynu. Ostatni, czwarty rozdział pracy opisuje sposoby, które do tej pory zostały przyjęte jako przeciwdziałające i zwalczające przestępstwo handlu narządami. Każdy z rozdziałów zawiera odwołania do obowiązującego prawa międzynarodowego publicznego, a w szczególności opiera się na analizie prawa funkcjonującego na terytoriach krajów europejskich.

This thesis is a presentation of the problem of organ trafficking in the context of human trafficking on the territory of European countries in the light of public international law. It consists of four chapters. The first one concerns human trafficking, its essence and forms, and it is an introduction to the further parts of the work. The second chapter contains an analysis of the concept of organ trafficking, comparing it to the concept of human trafficking, as well as the reasons for the procedure and the purposes of using the organs obtained from trafficking. The third chapter, entitled "Problems of organ trafficking," analyzes issues such as the commercialization of the human body, transplant tourism, organized crime and the concept of the victim in relation to this act. The final, fourth chapter of the thesis describes the ways that have so far been adopted to prevent and combat the crime of organ trafficking. Each of the chapters contains references to applicable public international law, and in particular is based on an analysis of the law operating in the territories of European countries.
