Rights of sexual minorities in the European Union. Conchita Wurst's case

Praca ma na celu przedstawienie praw mniejszości seksualnych w Unii Europejskiej w aspekcie zarówno teoretycznym, jak i praktycznym. Autorka prezentuje rozwój polityki niedyskryminacji osób LGBT w UE oraz występowanie zjawiska dyskryminacji ze względu na orientację seksualną i tożsamość płciową w państwach członkowskich. Tłem do rozważań nad tym tematem stała się postać Conchity Wurst, zwyciężczyni 59. Konkursu Piosenki Eurowizji, która jako "kobieta z brodą" wywołała falę kontrowersji w Europie i na świecie, przyczyniając się do wzmożenia dyskusji o tolerancji i dyskryminacji. By sprawdzić efektywność unijnej polityki niedyskryminacji w stosunku do osób LGBT, autorka bada wpływ członkostwa w UE oraz przepisów krajowych poszczególnych państw biorących udział w Eurowizji, na wyniki głosowania na Conchitę Wurst.

The thesis aims to present the rights of sexual minorities in the European Union, in both theoretical and practical aspects. The author presents the develpment of the EU's antidiscrimination policy towards LGBT persons and the occurence of the discrimination on the ground of sexual orientation and gender identity phenomenon in the member states. As a background for these considerations served the personage of Conchita Wurst, the winner of the 59th Eurovision Song Contest, who as a "bearded lady" provoked a massive controversy in Europe and in the world, contributing to the increasement of the discussion about tolerance and discrimination. In order to test the efficacy of the EU's antidisrimination policy towards LGBT persons, the author examines the influence of the membership in the EU and national legislative of the Eurovision participiating states, on the results of the voting for Conchita Wurst.
