Axiological foundations of the copyright law - libertarian perspective

Celem niniejszej pracy dyplomowej jest zbadanie i przedstawienie aksjologicznych podstaw prawa autorskiego w świetle klasycznego liberalizmu, tj. filozofii wolnego rynku i wolności osobistej. W pracy omówiono historyczne uwarunkowania powstania koncepcji autorskich praw majątkowych, prawno-naturalne aspekty ochrony autorsko-prawnej, własność intelektualną w świetle filozofii Johna Locke’a oraz ekonomiczną analizę prawa autorskiego. Rozważono deontologiczne i utylitarne argumenty przemawiające za ochroną autorsko-prawną. Uwzględnione zostały między innymi poglądy Ayn Rand, Lysandera Spoonera, Murraya Rothabrda, Richarda Posnera oraz przedstawicieli Austriackiej Szkoły Ekonomii i Instytutu Misesa. Szczególnie rozbudowany został rozdział poświęcony wolnościowej wizji świata pozbawionego systemu ochrony własności intelektualnej.

The aim of this thesis is to study classical liberal perspective on the axiological foundations of copyright law, especially taking free market and personal freedom issues into consideration. The paper discusses the historical circumstances of copyright conception, the natural law aspects of copyright protection, the idea of ownership in John Locke’s political philosophy and the economic analysis of copyright law. The thesis considers deontological and utilitarian arguments for copyright protection. Among other things the views of Ayn Rand, Lysander Spooner, Murray Rothabrda, Richard Posner, the representatives of the Austrian School of Economics and the Mises Institute were taken into account. The chapter particularly complex is the one which describes the libertarian vision of a world without intellectual property protection system.
