Tematem pracy jest zagadnienie sprawowania zwierzchnictwa terytorialnego przez państwo w swojej przestrzeni powietrznej. Opracowanie skupia się na analizie współczesnego statusu prawnego przestrzeni powietrznej w prawie międzynarodowym, umiejscawiając go na tle ogólnych rozwiązań dotyczących terytorium w prawie międzynarodowym. Szczególny nacisk został położony na prawne zasady funkcjonowania międzynarodowej żeglugi powietrznej w stosunku do praw suwerennych państw do dysponowania swoim terytorium. W pracy omówiono także kwestie prawa użycia siły wobec statków powietrznych.

The topic of the paper is the issue of territorial authority held by the state in its airspace. The study focuses on the analysis of the contemporary legal status of air space in international law, locating it against the background of general solutions concerning the territory in international law. Particular emphasis has been placed on the legal principles of the operation of international air navigation in relation to the rights of sovereign states to dispose of their territory. The paper also discusses the issue of the right to use force against flying object.
