Confidentiality of the communication and data protection in the telecommunications sector.

Założeniem pracy jest kompleksowe omówienie zagadnień związanych z tajemnicą telekomunikacyjną oraz innymi formami ochrony danych w sektorze telekomunikacyjnym. We wstępie zdefiniowane zostaną pojęcia kluczowe z punktu widzenia omawianego tematu, a mianowicie: telekomunikacja, łączność elektroniczna, dane, informacje, komunikat. Ponadto, przedstawione zostaną konstytucyjne oraz międzynarodowoprawne podstawy ochrony omawianych regulacji. Omówione zostaną poszczególne prawa i wolności jednostek mające znaczenie na gruncie komentowanej tematyki oraz podstawy do ich ograniczania. Autorka dokona analizy przepisów dotyczących tajemnicy telekomunikacyjnej w prawie polskim oraz prawie Unii Europejskiej, wskazujących na niedoskonałości polskiej regulacji. Ponadto, omówione zostanie zastosowanie przepisów dotyczących ochrony danych osobowych w sektorze telekomunikacyjnym i wzajemny stosunek pomiędzy tymi przepisami a regulacją sektorową. Zasygnalizowane zostaną również inne środki ochrony danych oraz prywatności, takie jak cywilistyczna ochrona dóbr osobistych oraz penalizacja czynów wymierzonych przeciwko ochronie informacji. Podsumowanie stanowiło będzie określenie wzajemnego stosunku omówionych form ochrony oraz ocena ich funkcjonowania.

The aim of the paper is a comprehensive overview of issues related to the confidentiality of communications and other forms of data protection in the telecommunications sector. In the introduction, the key terms of the subject matter will be defined, namely: telecommunications, electronic communications, data, information, communication. There also will be presented constitutional and international law basis for the protection of those basic rights. The Author will examine the rules on telecommunications secrecy under Polish law and the European Union law, pointing to the shortcomings of Polish regulations. In addition, the Author will discuss application of the provisions relating to the protection of personal data in the telecommunications sector and the relationship between the rules and regulation of the sector. There will also be presented other means of data protection and privacy, such as the protection under the Civil Code and criminalization of acts directed towards the protection of information. In the summary, the Author will state the relationship between all forms of data protection and summarize all of the regulations shortcomings mentioned in the paper.
