Psychological aspects of witnesses' testimonies in the criminal procedure

Niniejsza praca magisterska porusza tematykę psychologicznych aspektów zeznań świadków w postępowaniu karnym. Jej celem jest wykazanie znacznego wpływu psychologii na ten obszar, a jednocześnie zwrócenie uwagi na wciąż zbyt małe zainteresowanie nią organów procesowych i ich niewielkie przygotowanie do przesłuchania świadków w zakresie psychologicznym. W pracy tej podkreślona została rola psychologii w procesie kształtowania się zeznań na jego poszczególnych etapach – spostrzegania, zapamiętywania oraz odtwarzania. Przedstawiono również znaczenie znajomości ludzkiej psychiki i zachodzących w niej procesów dla efektywnego przesłuchania świadków, zarówno „zwyczajnych”, jak i szczególnych ich grup – dzieci, osób starszych i chorych psychicznie. Zwrócono także uwagę na cechy, jakie powinien posiadać dobry przesłuchujący. Niniejsza praca, poza opartą na polskim Kodeksie postępowania karnego procedurą odbierania zeznań, przedstawia ponadto inne, spotykane za granicą rodzaje przesłuchań, takie jak przesłuchanie poznawcze czy cross-examination. Wreszcie, praca ta zawiera omówienie różnych metod oceny wiarygodności zeznań świadków.

The present M.A. thesis brings up the subject of psychological aspects of witnesses’ testimonies in the criminal procedure.Its aim is to show the great influence of psychology on this area, as well as paying attention at the same time on the fact that the trial institutions are still not interested enough in psychology, and their poor preparation for witnesses’ testimony including psychological sphere.This M.A. thesis emphasizes the psychological role in the process of shaping testimonies on different stages- noticing, remembering and reconstruction. The importance of the knowledge of the human psyche has been introduced and all the processes taking place during the effective interrogation of the witnesses, both “common” and the specific groups such as children, elderly people and mentally ill. The attention has also been paid on the qualities which the interrogator should possess. The present M.A. thesis, besides the procedure of collecting testimonies based on Polish Code of Criminal Procedure, also shows foreign kinds of interrogation, such as cognitive interrogation and cross-examination.Finally, this M.A. thesis contains the review of different methods of evaluation of the witnesses’ testimonies credibility.
