Żadnych granic...a jednak?

No borders...or?

Tematem mojej pracy magisterskiej jest swobodny przepływ osób w strefie Schengen i jego związek z ideą kosmopolityzmu. Swoją pracę zaczynam od podstaw teoretycznych i dyskusji o kosmopolityzmie. W tej części pracy rozważam czy UE jest instytucją kosmopolityczną. Kolejny rozdział dotyczy sytuacji prawnej w zakresie swobodnego przepływu osób w strefie Schengen. Na końcu dokonuję analizy jakościowej aktów prawnych wydanych przez UE od połowy marca do połowy czerwca 2020, dotyczących zamknięcia granic w związku z pandemią Covid-19.Najważniejszym rezultatem mojej pracy jest wniosek, że strefa Schengen opiera się na dobrej woli państw członkowskich i nie istnieje instytucjonalne zabezpieczenie dla kosmopolitycznej Europy.

The topic of my master's thesis is the free movement of persons in the Schengen area and its connection with the idea of ​​cosmopolitanism. I begin my work with a theoretical basis and a discussion on cosmopolitanism. My main question in this part of my work is whether the EU is cosmopolitan. The next chapter deals with the legal situation regarding the free movement of persons in the Schengen area. Finally I conduct a quality analysis of legal acts, brought by the EU from mid-March to mid-June 2020, on border closings because of the Covid-19 pandemic.The most important result of my thesis is that Schengen area is based on the goodwill of the member states and there is no institutional guarantee for cosmopolitic Europe.

Das Thema meiner Masterarbeit ist die Personenfreizügigkeit im Schengenraum und der Zusammenhang mit der Idee des Kosmopolitismus. Ich beginne meine Arbeit auf der theoretischen Basis und einer Diskussion zum Kosmopolitismus. Dabei diskutiere ich inwieweit die EU kosmopolitisch ist. Ein weiteres Kapitel beschäftigt sich mit der Rechtslage zur Personenfreizügigkeit im Schengenraum. Das letzte Kapitel ist eine qualitative Analyse von Rechtsvorschriften, die von der EU von Mitte März bis zum Mitte Juni 2020 herausgegeben wurden, zum Thema Grenzschließungen während der Covid-19-Pandemie.Das wichtigste Ergebnis meiner Arbeit ist die Schlussfolgerung, dass Schengen auf gutem Willen der Mitgliedstaaten basiert und eine institutionelle Versicherung für ein kosmopolitisches Europa nicht vorhanden ist.
