Collective management of copyright or neighbouring rights in Poland

W niniejszej pracy magisterskiej została przedstawiona analiza zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi w Polsce, przede wszystkim poprzez opisanie najważniejszych kwestii dotyczących organizacji zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi. Pierwszy rozdział zawiera rozważania na temat charakteru prawnego organizacji zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi w Polsce. Jego treść skupia się na statusie tych organizacji, odnosząc się w szczególności do przepisów ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych . Następnie zaprezentowane zostały kwestie dotyczące utworzenia organizacji zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi. Omówienie tego zagadnienia wymagało przedstawienia odpowiedniej procedury oraz nawiązania do przepisów ustawy z dnia 7 kwietnia 1989 r. Prawo o stowarzyszeniach. Treść drugiego rozdziału odnosi się do aspektu funkcjonowania organizacji zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi w Polsce. Zostały w nim zaprezentowane kwestie związane z zadaniami tych podmiotów, członkostwem w nich oraz sprawowaniem nad nimi nadzoru. Trzeci rozdział przedstawia już problematykę zakresu i sposobu działania organizacji zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi w Polsce. Dokonano w nim omówienia takich zagadnień, jak: powierzanie praw autorskich lub praw pokrewnych takim organizacjom, zbiorowy zarząd prawami autorskimi lub prawami pokrewnymi w stosunkach wewnętrznych, zbiorowy zarząd prawami autorskimi lub prawami pokrewnymi w stosunkach zewnętrznych, tabele wynagrodzeń, działanie wielu organizacji zbiorowego zarządzania, domniemania związane z działalnością organizacji zbiorowego zarządzania, porozumienia między organizacjami zbiorowego zarządzania, założenia Dyrektywy 2014/26 w sprawie zbiorowego zarządzania prawami autorskimi i prawami pokrewnymi. Rozdział czwarty stanowi swoiste podsumowanie i ocenę zbiorowego zarządzania prawami autorskimi lub prawami pokrewnymi w Polsce. Zaprezentowano w nim wszelkie wnioski wynikające z analizy przeprowadzonej w niniejszej pracy magisterskiej.

This master thesis presents an analysis of the collective management of copyright or neighbouring rights in Poland, primarily by describing the most important issues concerning the organizations for the collective administration of copyright or neighbouring rights. The first chapter contains reflections on the legal nature of the organizations for the collective administration of copyright or neighbouring rights in Poland. Its content focuses on the status of these organizations, referring in particular to the provisions of the Law on Copyright and Related Rights of 4 February 1994. Subsequently, this master thesis presents issues related to the creation of the organization for the collective administration of copyright or neighbouring rights. Discussion of this issue required presentation of a proper procedure and reference to the provisions of the Law on Associations of 7 April 1989. The content of the second chapter refers to the aspect of functioning of the organizations for the collective administration of copyright or neighbouring rights in Poland. It describes the tasks of these entities, membership in them and supervision over them. The third chapter presents the issues of the scope and manner of functioning of the organizations for the collective administration of copyright or neighbouring rights in Poland. It describes the issues such as: the entrustment of copyright or neighbouring rights to these organizations, the collective management of copyright or neighbouring rights in internal relations, the collective management of copyright or neighbouring rights in external relations, remuneration tables, the activity of many collective administration organizations, presumptions connected with the activity of collective administration organizations, agreements between collective administration organizations, the regulations of the Directive 2014/26/EU of The European Parliament and of The Council of 26 February 2014 on collective management of copyright and related rights and multi-territorial licensing of rights in musical works for online use in the internal market. Chapter Four presents summary and opinion on the collective management of copyright or neighbouring rights in Poland. It contains all conclusions resulting from the analysis carried out in this master thesis.
