Copyright protection of photographic work

Praca prezentuje problematykę związaną z uznaniem fotografii za przedmiot ochrony w rozumieniu ustawy o prawie autorskim i prawach pokrewnych. W części pierwszej odwołano się do regulacji ustawowych sprzed roku 1994, aby ukazać ewolucję objęcia ochroną ten rodzaj twórczości. Następnie, dokonując analizy przesłanek utworu na gruncie aktualnego stanu prawnego, zwrócono uwagę na specyfikę utworu fotograficznego. W rozdziale trzecim poddano analizie wybrane rodzaje fotografii, rozważając przy tym, które z nich stanowią przedmiot prawa autorskiego, a które nie. W następnej części wskazano prawa, jakie przysługują twórcy utworu fotograficznego oraz omówiono problematykę związaną z korzystaniem z fotografii znajdujących się w internecie. Ostatni rozdział poświęcony został odpowiedzialności z tytułu naruszeń praw autorskich do utworu fotograficznego.

This thesis presents the problem issues related to recognition of photography as an objects of laws protection within the meaning of the Copyright and Related Rights Act. The first part referred to legal regulations before 1994, to illustrate the evolution of the protection of this kind of creativity. Then, while analyzing the premise of the work on the basis of the current legal status, attention was paid to the specifics of the photographic work. In the third chapter analyzed selected types of photography, considering which of them are the subject of copyright and which are not. The next section outlines the rights, that the authors of a photographic work have and issues related to the use of photographic work on the Internet were discussed. The last chapter referred to responsibility for copyright infringement of a photographic work.
