The purpose and range of application of the notification institution in Polish construction law.

Niniejsze opracowanie omawia instytucję zgłoszenia robót budowlanych na gruncie polskiego prawa budowlanego. Przedstawiane zagadnienia ujęte zostały w czterech rozdziałach. W pierwszym z nich omówiona została istota zgłoszenia robót budowlanych. Wprowadzeniem do pracy stały się zagadnienia przedmiotu prawa budowlanego oraz formy reglamentacji robót budowlanych. Następnie uwaga skupiona została na celu zastosowania przedmiotowego zgłoszenia oraz jego charakterze prawnym i zakresie zastosowania. W rozdziale drugim zaprezentowano zgłoszenie budowlane jako formę realizacji wolności budowlanej. Kolejny rozdział jest omówieniem przebiegu postępowania w sprawie zgłoszenia robót budowlanych. Zwraca się tu szczególną uwagę na etap zakończenia postępowania - omówione zostają milcząca zgoda organu oraz jego sprzeciw do zgłoszenia. Ostatni, czwarty rozdział skupia uwagę na zagadnieniu samowoli budowlanej, sankcjach z nią związanych oraz sposobie jej legalizacji.

This study discusses the institution of notification of construction works under Polish construction law. The presented issues are included in four chapters. In the first of these, the essence of the notification of construction works was discussed. The introduction to the work has become the subject of the construction law and the form of rationing of construction works. Next, the attention was focused on the purpose of the application, its legal nature and scope of the notification institution. The second chapter presents a notification of construction works as a form of construction freedom implementation. The next chapter is a discussion of the proceedings regarding the notification of construction works. Particular attention is paid here to the stage of completion of the proceedings - the tacit agreement of the public authority and its opposition to the notification are discussed. The last, fourth chapter focuses on the issue of unauthorized construction, sanctions associated with it and the method of its legalization.
