States of exception

Niniejsza praca poświęcona została stanom nadzwyczajnym w Polsce i w innych państwach europejskich. Rozdział pierwszy stanowi wprowadzenie do tematu i koncentruje się wokół definicji pojęcia „stan nadzwyczajny” oraz ogólnych zasad stanów nadzwyczajnych w Polsce takich jak: zasada wyjątkowości, zasada legalności, proporcjonalności, celowości, zasada ochrony podstaw systemu prawnego, zasada ochrony organów przedstawicielskich, odnoszących się do wszystkich stanów nadzwyczajnych. Rozdział drugi niniejszej pracy opisuje stany nadzwyczajne przewidywane przez prawo konstytucyjne: stan wojenny, stan wyjątkowy, stan klęski żywiołowej. Opisany w nim został równiej stan wojny. Trzecia część pracy poświęcona została stanom nadzwyczajnym w poszczególnych państwach Unii Europejskiej, przede wszystkim: Wielkiej Brytanii, Niemiec i Francji. Ostatnia część pracy koncentruje się wobec konsekwencji wprowadzenia stanu nadzwyczajnego. Omówione w nim zostały ograniczenia praw i wolności człowieka i obywatela oraz regulacje tychże ograniczeń zarówno na płaszczyźnie międzynarodowej jak i w ustawodawstwie polskim, a także zasady funkcjonowania organów władzy publicznej w czasie trwania stanu nadzwyczajnego.

This work is devoted to the States of exception in Poland and other European countries. The first chapter is an introduction to the subject and focuses on the definition of the term “state of exception” and on the general principles of states of exception in Poland, such as the principle of legality, proportionality, finality, the principle of protection of basics of law system, the principle of protection of representative bodies relevant to all states of exception. The second chapter of this work describes the states of exception foreseen by the constitutional law: martial law, state of emergency, state of natural disaster. It has been described the state of war too. The third part of the work is devoted to the states of exception in the individual European Union countries, especially in Great Britain, Germany and France. Last part of the work is focused towards the consequences of the introduction of state of exception. There have been covered the limitations of the Rights and Freedoms of Man and Citizen and the regulations of these limitations both at the international level as well as in the Polish legislation and also the principles of the functioning of public authorities during the state of exception.
