Not only emptio spei : as far as some cases of the aleatory sale are concerned

W literaturze romanistycznej wiele uwagi poświęcono niezwykle interesującym kontraktom emptio spei oraz emptio rei speratae. Z uwagi na fakt, że w odniesieniu do obydwu wspomnianych umów zaistnienie przedmiotu sprzedaży zależało, w mniejszym lub większym stopniu od przypadku, w poświęconych im pracach akcentuje się ich aleatoryjny charakter. Równie interesujące z tego punktu widzenia wydają się być inne typy sprzedaży aleatoryjnej, które nie cieszyły się dotychczas tak dużym zainteresowaniem badaczy, jak wspomniane emptio spei oraz emptio rei speratae. Mowa o analizowanych przez jurystów klasycznych kontraktach: emptio quasi spes hereditatis, emptio servi fugitivi oraz emptio servi alieni qui heres institutus est. Na naszą uwagę zasługuje zarówno ich wyszukana konstrukcja prawna, ujmująca los (ryzyko, szansę na szczęśliwy traf) jako immanentną cechę kontraktu, jak i szeroki zakres wykorzystania losowości wzbogacającej typową umowę emptio-venditio, a przez to znacząco rozszerzającej jej gospodarcze znaczenie.

Plenty of attention has been paid to extraordinarily interesting contracts emptio spei and emptio rei speratae in Romanistic literature. By dint of the fact that in relation to both mentioned agreements, coming of the object of a sale into existence depended more or less on an occurrence, their aleatory nature is accentuated in works dedicated to them. Other kinds of the aleatory sale which so far have not been of such strong interest of scholars as the mentioned emptio spei and emptio rei speratae, seem to be as much curious from this point of view. The study presents contracts analyzed by classical jurists: emptio quasi spes hereditatis, emptio servi fugitivi oraz emptio servi alieni qui heres institutus est. Either their sophisticated legal construction including fate (the risk, a chance of good luck) as the immanent feature of a contract or a wide range of using randomness enriching a typical emptio-venditio agreement and due to it considerably expanding its economic importance, deserve one’s attention.
