Tematem niniejszej pracy jest Monteskiuszowska teoria podziału władzy oraz jej pozostałości w polskim ustroju państwowym. Cel pracy sprowadza się do uzyskania odpowiedzi na pytanie jak wiele elementów teorii Monteskiusza zostało wykorzystanych we współczesnej polityce ustrojowej.Temat wydaje się ciekawy głównie z uwagi na to, że łączy w sobie historyczne ujęcie problemu powracając do doktryn z czasów Starożytności, Średniowiecza oraz Oświecenia, a także pozwala na dokonanie analizy porównawczej – porównuje się tu monteskiuszowską teorię ze współczesnymi rozwiązaniami ustrojowymi zastosowanymi w naszym kraju.Mimo, że temat ten jest szeroko poruszany przez różnego rodzaju media oraz literaturę, wiele w tych informacjach spekulacji i domysłów. Praca ta ma na celu przede wszystkim wskazanie na czym polega teoria Monteskiusza i jakie są jej najważniejsze postulaty. Do zadań pracy należy także zobrazowanie ustroju III Rzeczypospolitej.W niniejszej pracy poszukuje się odpowiedzi na następujące pytania: jaka jest geneza teorii podziału władzy i teorii ustroju mieszanego? Na czym polega teoria podziału władzy opracowana przez Monteskiusza? Jak wyglądają najważniejsze zasady ustrojowe funkcjonujące w ramach państwowego ustroju we współczesnej Polsce?W opracowaniu tym została również podjęta próba wyjaśnienia podobieństw i różnic między opisywaną doktryną Monteskiusza a jej pozostałościami w konstytucyjnych rozwiązaniach zastosowanych w polskiej ustawie zasadniczej z 2 kwietnia 1997 roku.

The theme of this work is to Montesquieu's theory of separation of powers and the system remains in the Polish state. Aim boils down to answer the question of how many items were used Montesquieu's theory in contemporary political policy.Seems to be an interesting topic mainly due to the fact that it combines a historical approach to the problem of returning to the doctrines of the time of Antiquity, the Middle Ages and the Enlightenment, and also allows you to make a comparative analysis - Montesquieu here compares with the modern theory of fluids solutions applied in our country.Although this topic has been widely discussed by various media and literature, a lot of information in these speculations and conjectures. This work is aimed primarily an indication of what the theory of Montesquieu, and what are its main demands. The tasks of the operating system should also display the Third Republic.In this paper seeks to answer the following questions: what is the origin of the theory of separation of powers and the theory of the mixed system? What is the theory of separation of powers developed by Montesquieu? What are the most important constitutional principles operating within the state system in Poland today?The study has also attempted to clarify the similarities and differences between the doctrine of Montesquieu described and its remnants in the constitutional solutions used in Polish to the constitution of 2 April 1997.
