The Potestative Condition in the Roman and in the Contemporary Polish Private Law

Przedmiotem niniejszej pracy jest analiza problematyki warunku zależnego od woli stron (warunku potestatywnego) w rzymskim i współczesnym polskim prawie prywatnym. W rozdziale pierwszym omówiono zagadnienie warunku (condicio) w źródłach prawa rzymskiego, przede wszystkim zaś kompilacji justyniańskiej. Przedstawiona została wieloznaczność łacińskiego terminu condicio oraz wynikające z rozważań jurysprudencji cechy warunku, odróżniające go od terminu, polecenia czy przyczyny dokonania czynności. W drugim rozdziale przedstawione zostały rodzaje warunków wyróżniane przez rzymską jurysprudencję oraz sposób wyróżnienia warunku potestatywnego. Następnie została przedstawiona kwestia dopuszczalności warunku zależnego od woli stron i sposobów jego wypełnienia. Ostatni rozdział poświęcony jest współczesnemu prawu polskiemu. Zawiera przedstawienie historii uregulowania warunku od Kodeksu zobowiązań (1933 r.) do obowiązującego dziś Kodeksu cywilnego. Kolejna część dotyczy kwestii wyróżnienia warunku potestatywnego i jego dopuszczalności w doktrynie i orzecznictwie.

The aim of the work hereby is the analysis of the potestative condition issues, which conditions are dependent on the will of the parties, on the basis of the Roman and the contemporary Polish private law. In Chapter 1 we describe the problem of the condition (condicio), as presented in the sources of the Roman law, with a special focus on the Compilation of Justinian. We demonstrate the ambiguity of the Latin term condicio and the condition characteristics resulting from the jurisprudence deliberation, which characteristics distinguish the condition from the time clause, the instruction and the cause of activity performance. Chapter 2 contains types of conditions determined by Roman jurisprudence, and the way of determination of the potestative condition itself. Thereafter we describe the issue of admissibility of the potestative condition, which is dependent on the will of the parties and the way of its fulfilment. Chapter 3 describes contemporary Polish law and contains a presentation of the history of the condition regulation, from the Code of Obligations (1933) up to the Civil Code currently in force. The last part of this work concerns the determination of the potestative condition and its admissibility in the doctrine and in the judicature.
