Anonymous witness in Polish criminal procedure

Celem mojej pracy jest przybliżenie instytucji świadka anonimowego – począwszy od tego dlaczego w ogóle znalazła się ona w polskim procesie karnym, poprzez sposób jego ochrony w porównaniu z ochroną świadka “zwykłego”, a także omawiając praktyczne zastosowanie opisując obraz przesłuchań. Szczególny nacisk został położony na poszukiwanie odpowiedzi na pytania związane z relacją świadka anonimowego i zasad procesu, zaś poczynione obserwacje zostały podparte opiniami doktryny oraz sądów, zarówno polskich, w szczególności Sądu Najwyższego, jak i międzynarodowych w postaci Europejskiego Trybunału Praw Człowieka.

The aim of my work is to introduce the institution of an anonymous witness - starting with why it was included in the Polish criminal process at all, through the way the witness is protected compared to the protection of an "ordinary" witness, as well as discussing its practical application by describing the image of interrogations. Particular emphasis was placed on seeking answers to questions related to the anonymous witness's account and the rules of the trial, and the observations made were supported by the opinions of the doctrine and courts, both Polish, in particular the Supreme Court, and international in the form of the European Court of Human Rights.
