Directions of the evolution of the Schengen acquis in the light of the proposals of the European Commission after 2011

Francusko-włoska inicjatywa reformy zarządzania strefą Schengen, przedstawiona w następstwie incydentu w Ventimiglia w kwietniu 2011 roku, zaowocowała pakietem propozycji legislacyjnych wysuniętych przez Komisję Europejską w listopadzie 2011 roku. Niniejszy artykuł zawiera szczegółową i dogłębną analizę propozycji Komisji w kontekście trendów i uwarunkowań ewolucji obszaru Schengen. Tezą rozwijaną w tym artykule jest twierdzenie, iż propozycje Komisji prowadzą do wzmocnienia hybrydowego modelu zarządzania w strefie Schengen, co pociąga za sobą powiązanie ponadnarodowych form monitorowania i kontroli z krajowymi instrumentami sekurytyzacji wynikającymi z tradycyjnego pojmowania interesów narodowych i suwerennej jurysdykcji państw członkowskich.

The Franco-Italian initiative of a reform of Schengen governance, put forward in a follow-up to the Ventimiglia incident of April 2011, resulted in a package of legislative proposals offered by the European Commission in November 2011. This paper provides a detailed and in-depth analysis of the Commission’s proposal and looks forward to trends and determinants of the Schengen area. The thesis developed throughout the paper is that the Commission’s proposals bring about the reinforcement of the hybrid governance in the Schengen area entailing both transnational methods of monitoring and control as well as national instruments of securitization resulting from the traditional meaning of national interests and sovereign jurisdiction of the Member States.
