Sąd Najwyższy trafnie rozstrzygnął problem skuteczności zapisu na sąd polubowny w sytuacji, gdy został on zawarty w stosunku do jednego ze współuczestników procesowych dowolnych materialnych, a nie był ukonstytuowany w stosunku do drugiego takiego współuczestnika. Regulacja przepisów Kodeksu postępowania cywilnego, jak też Kodeksu cywilnego, nie daje prostej odpowiedzi na pytanie, jak zapis na sąd polubowny wpływa na sytuację procesową podmiotów związanych ze stosunkiem prawnym objętym zapisem na sąd polubowny. Komentowana uchwała nasuwa oczywiste pytanie o granice skuteczności zapisu na sąd polubowny na gruncie procesu cywilnego. The Supreme Court [SC] correctly resolved the problem of the effectiveness of an arbitration clause in a situation where it was included with respect to one of the optional substantive co-participants in proceedings and it was not constituted with respect to the other such co- -participant. Neither the provisions of the Code of Civil Procedure, not those of the Civil Code give a simple answer to the question how the arbitration clause is infl uenced by the procedural status of entities connected with the legal relationship to which the arbitration clause applies. The commented SC resolution brings to mind the obvious question about the limits of effectiveness of an arbitration clause in the civil procedure. The importance of the issue discussed by the SC for the practice of business transactions calls for a more thorough refl ection about this and related problems, the more so that arbitration is quickly growing in popularity as an attractive alternative dispute resolution method. Moreover, the resolution is a valuable contribution to a more general discussion about how the arbitration clause infl uences the procedural status of entities in whose case there occurs one of the kinds of joint participation in proceedings analysed by the SC.
