Przedmiotem opracowania jest konwencja nr 158 Międzynarodowej Organizacji Pracy dotycząca rozwiązania stosunku pracy z inicjatywy pracodawcy, które jest uzupełniona zaleceniem nr 166. Autor podkreśla szeroki zakres podmiotowy i przedmiotowy ochrony przed nieuzasadnionym wypowiedzeniem, w tym konieczność zaistnienia odpowiedniej przyczyny rozwiązania umowy na czas nieokreślony. Wyraża również pogląd, że polskie ustawodawstwo nie spełnia standardów prawa międzynarodowego, w szczególności ze względu na dopuszczalność szerokiego stosowania umów o pracę na czas określony, a także brak ustawowego obowiązku zapewnienia pracownikowi obrony przed postawionymi zarzutami, jeżeli motywem zwolnienia miałoby być jego zachowanie lub sposób wykonywania pracy.

The elaboration is dedicated to the Convention No. 158 of the International Labour Organization concerning Termination of Employment at the Initiative of the Employer, that is supplemented by the recommendation No. 166. Authors emphasizes the broad personal and material scope of protection against unjustified dismissal, including the reason of termination of an open-ended employment contract. Author is of the opinion that Polish law does not meet international standards, in particular due to excessive admissibility to conclude fixed-term employment contracts, and the lack of statutory requirement to guarantee the worker an opportunity to defend himself against the allegations made, if the employment is to be terminated for reasons related to the worker’s conduct or work performance.
