Przesłanką dopuszczalności skargi o stwierdzenie niezgodności z prawem prawomocnego orzeczenia jest wyrządzenie szkody. Sposób rozumienia tego pojęcia determinuje zakres dopuszczalności skargi. W judykaturze oraz doktrynie wyrażane są poglądy, iż skarga jest niedopuszczalna, jeżeli szkoda polega wyłącznie na poniesieniu kosztów procesu, ma „znikomy”, „symboliczny” rozmiar, jak również, gdy szkoda powstanie po upływie dwóch lat od uprawomocnienia orzeczenia. Autorka przeprowadza krytyczną analizę tych poglądów.

A prerequisite for the admissibility of an action to declare a final judgement unlawful is the damage caused. The manner of understanding this concept determines the scope of admissibility of the complaint. The judicature and doctrine express views that the complaint is inadmissible, if the damage consists only in incurring the costs of the proceedings, it has a "negligible", "symbolic" size, as well as when the damage occurs after two years from the validation of the decision. The author carries out a critical analysis of these views.
