Celem artykułu jest przedstawienie zakresu przedmiotowego dopuszczalności zażalenia w procesie karnym, a także wskazanie podmiotów uprawnionych do złożenia środka zaskarżenia. Podstawy prawne postępowania odwoławczego mają swoje źródło zarówno w przepisach prawa krajowego na czele z Konstytucją RP, jak też postanowieniami prawa międzynarodowego. Stosownie do treści art. 459 k.p.k. Zażalenie przysługuje na postanowienia sądu zamykające drogę do wydania wyroku, chyba że ustawa stanowi inaczej oraz na postanowienia co do środka zabezpieczającego oraz na inne postanowienia w wypadkach przewidzianych w ustawie. Zażalenie przysługuje stronom, a także osobie, której postanowienie bezpośrednio dotyczy, chyba że ustawa stanowi inaczej. W tekście zostaną wskazane cechy zażalenia jako środka względnie dewolutywnego i suspensywnego, wskazane zostaną postanowienia i zażalenia, na które służy zażalenie, a także krytyce zostaną poddane rozwiązania legislacyjne w tym zakresie. Niezmiernie istotne jest powiązanie prawa do zaskarżania orzeczeń w kontekście zasady dwuinstancyjności i zasady prawa do rzetelnego procesu. W końcowej części opracowania Autor formułuje sześć postulatów, które mają zmienić.
The subject of the article is presentation of procedural decisions, from which a complaint can be brought in criminal proceedings, and also the group of parties entitled to submit this measure. It is worth emphasizing that the principles of appeal proceedings originate both in the Polish law, the most significant of which are the Constitution of the Republic of Poland, as well as international agreements such as the European Convention for the Protection of Human Rights. According to 459 § 1. Code of criminal procedure complaints may be brought against the decisions of a court which preclude the rendering of a judgment and also against decisions with respect to a preventive measure, and against other decisions in cases prescribed under the Act. The right to file a complaint shall be vested in the parties and also in any person directly concerned by the decision, unless otherwise provided in the Act. The article will list the features of the complaint, the indicated decisions to which the complaint applies, and also criticized the current applicable provisions of the Code of Criminal Procedure in this regard. It is extremely important right to appeal against judgments and decisions made at first stage, and connection between the complaint and the principle of two-instances and the principle of the right to a fair trial will be stressed. At the end of the study, the author formulates six postulates that should improve the procedure initiated by the complaint.
