Celem opracowania jest przedstawienie istoty delegowania pracowników w ramach unijnej swobody świadczenia usług, a także zasygnalizowanie głównych wątpliwości i dylematów w tej dziedzinie. Szczególnie istotne znaczenie przypada określeniu relacji pomiędzy dwoma wartościami istotnymi dla procesu integracji europejskiej. Z jednej strony są to swobody gospodarcze rynku wewnętrznego (w tym swoboda świadczenia usług), a z drugiej polityka społeczna i ochrona praw pracowniczych. Co istotne, legalne delegowanie pracowników stanowi formę mobilności pracowników, która wpisuje się w założenia rynku wewnętrznego i nie może być utożsamiana z tzw. dumpingiem socjalnym. W artykule zaprezentowano dyrektywy 96/71 oraz 2014/67 dotyczące delegowania pracowników oraz zmieniający się kontekst ich funkcjonowania, w szczególności ze względu na rozszerzenie Unii Europejskiej o państwa Europy Środkowej i Wschodniej. Autor uwypukla konieczność zapewnienia zarówno uczciwej konkurencji, jak i ochrony praw pracowniczych. Przedstawia również problemy związane z egzekwowaniem przepisów o delegowaniu pracowników; zakres ograniczeń, które państwa przyjmujące mogą nakładać na przedsiębiorstwa delegujące, a także dążenia do nowelizacji dyrektywy 96/71.
The paper aims to present the essense of posting of workers within the framework of EU freedom to provide services, while mentioning the main doubts and dilemmas in this area. Special importance is given to determining the relationship between two values that are pivotal for the process of European integration. On the one hand, there are economic freedoms of the internal market (including the freedom to provide services), while on the other, we have social policy and workers' rights protection. Importantly, lawful posting of workers is a form of workers' mobility, which is consistent with the assumptions of the internal market and cannot be equated with the so-called "social dumping". The article presents Directives 96/71/EC and 2014/67/EU, which concern the posting of workers, and the changing context in which these Directives function, in particular due to the accession to the EU of countries of Central and Eastern Europe. The author also emphasizes the need to guarantee both fair competition and protection of workers' rights. Furthemore, he discusses the problems connected with enforcing the provision on the posting of workers, the restrictions that host states can impose on the enterprises that post workers, as well as the attempts to amend Directives 96/71/EC
