Komentowane orzeczenie Sądu Najwyższego (IV KK 114/16) wiąże się z fundamentalnym prawem oskarżonego w procesie karnym. Autor akceptuje obie tezy orzeczenia i dokonuje oceny rozstrzygnięcia w perspektywie normatywnej i prakseologicznej. Fakt, że "oskarżony nie może ponosić negatywnych konsekwencji niedopełnienia przez obrońcę wymogów określonych w art. 117 § 2a k.p.k.", w obecnym modelu procesu karnego nie powinien budzić żadnych zastrzeżeń. Instytucja lekarza sądowego ma charakter gwarancyjny, zapobiegający sytuacjom poświadczania nieprawdy. Niemniej jednak (tak jak w komentowanym orzeczeniu) nie zawsze uczestnik procesu jest w stanie dopełnić obowiązku z art. 117 § 2 a k.p.k. Stąd też, potrzeba "refleksyjnego" spojrzenia sądów, w sytuacji gdy uczestnik nie dopełnił tego obowiązku, a istnieje obiektywna przeszkoda zdrowotna, ewidentnie uniemożliwiająca jego przybycie na rozprawę.

Discussed ruling of the Supreme Court (IV KK 114/16) involves a fundamental right of the accused in the criminal procedure. The author accepts both theses of the ruling and evaluates the resolution taking into account normative and praxeological perspective. The fact that "the accused shall not suffer the negative consequences of non-fulfilment by the attorney of requirements referred to in Art. 117 § 2a of the Code of Criminal Procedure" in the current model of the criminal procedure should not raise any objections. The court-appointed physician is a guarantee to prevent situations of certifying an untruth. However (as in discussed ruling) the participant of the procedure is not always able to fulfil the obligation of Art. 117 § 2a of the Code of Criminal Procedure. Hence, the need for 'reflective' approach of courts in the situation when the participant did not fulfil this obligation, and there is an objective health obstacle, evidently preventing his arrival at the trial.
