W artykule został omówiony projektowany artykuł 178 § 1a Kodeksu karnego, zgodnie z którym ustawowe zagrożenie karą za spowodowanie ciężkiego wypadku przez sprawcę znajdującego się w stanie nietrzeźwości lub pod wpływem środków odurzających, albo sprawcę, który zbiegł z miejsca zdarzenia, ma wynosić co najmniej 2 lata pozbawienia wolności. Autorzy wskazują, że projektodawca wydaje się nie zdawać sobie sprawy z konsekwencji wprowadzenia do Kodeksu karnego przepisu o takiej treści, a także pomija kontrowersje, związane z prawnym charakterem omawianej instytucji, pojawiające się w nauce prawa karnego i w orzecznictwie. Zdaniem autorów, przepis wymaga przeredagowania i dostosowania do aktualnie obowiązujących regulacji Kodeksu karnego.

In the paper the authors discuss a stipulated Article 178 § 1a of Polish Penal Code (PPC). Article 178 § 1a of PPC states that in case of causing grievous bodily harm by a perpetrator while being drunk or under the influence of intoxicating agent, or when the perpetrator escapes from the scene of incident, the lower limit of the legal risk shall not be less than two years of imprisonment. The authors point out that the legislator is not aware of the consequences of introducing such regulation to the PPC. They also neglect the controversies associated with the legal essence of the discussed institution which are found in the jurisprudence. The authors express the opinion that the stipulated article needs to be modified and therefore adapted to current regulations.
