The right coalition in temporary employment relationships

W niniejszym artykule przedstawiam uwarunkowania prawne dotyczące prawa koalicji w stosunkach pracy tymczasowej. Specyfika zatrudnienia tymczasowego, którego podmiotami po stronie pracodawczej są zarówno agencja pracy tymczasowej, jak również pracodawca użytkownik, stwarza wątpliwości interpretacyjne dotyczące wolności związkowych pracowników tymczasowych. Główne rozważania poprzedzone zostały wstępem prezentującym zagadnienie wolności związkowych w świetle Konstytucji RP, uregulowań prawa unijnego oraz norm prawa międzynarodowego ze szczególnym uwzględnieniem dorobku legislacyjnego Międzynarodowej Organizacji Pracy. W części głównej artykułu prezentuję aktualne poglądy doktryny i orzecznictwa Sądu Najwyższego na omawiany temat. Przedstawiam dylematy dotyczące zakresu podmiotowego i przedmiotowego prawa koalicji oraz wpływ relacji występujących w stosunkach pracy tymczasowej na uprawnienia i wolności związków zawodowych wynikających ze zbiorowego prawa pracy stosowanego w typowych formach zatrudnienia pracowniczego. Analizowana tematyka ujęta jest zarówno w perspektywie teoretycznej, jak również praktycznej wynikającej ze stosowania obowiązujących przepisów ustawy o związkach zawodowych oraz ustawy o zatrudnieniu pracowników tymczasowych. W zakończeniu artykułu dokonuję syntetycznego podsumowania tematu zarówno w ujęciu de lege lata, jak również de lege ferenda.

In this article I present the regulations concerning the right coalition in temporary employment relationships. The specificity of temporary employment, the employer's parties of which are both temporary employment agency, as well as employer-user, creates doubts concerning interpretation of freedom of union association of temporary workers. The main considerations were preceded by an introduction that presents the issue of freedom of association under the Constitution of Poland, provisions of European Union law and the norms of international law with particular emphasis on legislative achievements of the International Labour Organization. The main part of the articles presents the views of the doctrine and jurisprudence of the Supreme Court of the topic. The article presents the dilemmas regarding the scope of subject and object of law coalition and the impact of the relationships in labor relations on right and freedom of trade unions resulting from collective labor law applied in typical forms of employment law. The analyzed topics is included in both the theoretical as well as practical resulting from the application of existing provisions of the Act on trade unions and the Act on the employment of temporary workers. In conclusion, I make a synthetic overview of the subject from both de lege lata and de lege ferenda poits of view.
