Do najistotniejszych nowości w elektronicznym postępowaniu upominawczym, wprowadzonych do KPC na mocy ustawy z dnia 10.7.2015 r. o zmianie ustawy - Kodeks cywilny, ustawy – Kodeks postępowania cywilnego oraz niektórych innych ustaw, należy instytucja umorzenia postępowania na wniosek powoda zgłoszony w pozwie, w razie ziszczenia się określonych w ustawie okoliczności wyłączających dopuszczalność wydania nakazu zapłaty w tym postępowaniu lub skutkujących uchyleniem tego orzeczenia z urzędu i przekazaniem sprawy do sądu właściwości ogólnej. Niniejsza publikacja (stanowiąca II część artykułu poświęconego badanej instytucji) obejmuje problematykę charakteru prawnego orzeczenia o umorzeniu procesu na wniosek powoda, kosztów postępowania umorzonego w badanym trybie, wpływu umorzenia EPU na wniosek powoda złożony w pozwie na materialnoprawne skutki wytoczenia powództwa (w tym zwłaszcza przerwę przedawnienia wywołaną wniesieniem pozwu) oraz zaskarżania (kontroli) orzeczeń w przedmiocie umorzenia EPU na wniosek powoda.

Termination of the electronic proceedings by writ of payment at the request of the claimant submitted in a statement of claim in the event of the occurrence of some law-specified circumstances barring the issuance of the writ of payment or triggering its ex officio annulment and the transfer of the case to the competent court of general jurisdiction, may be perceived as the most important innovation in these proceedings introduced to the Polish Code of civil proceedings (hereinafter referred to as: “CCP”) under the Act of 07.10.2015 r. amending Civil Code, Code of Civil Procedure and some other laws. In this paper (part 2 of the article on the issue in question), the author analyses the legal nature of the court’s decision terminating proceedings in accordance with a motion of a claimant, costs of terminated proceedings, the impact of the termination of the proceedings at the request of a claimant on the effects caused by the lodging of a claim pursuant to the applicable provisions of substantive law as well as the appellate measures against court’s decisions ruling on the issue in question.
