Does every culture deserves a defence? : few queries concerning cultural defence and criminal law in the age of multiculturalism

The aim of the article is to present few queries concerning extensively discussed issue of cultural defence. The point of reference is ideology of multiculturalism. Main focus is placed on an attempt to reconstruct and present presumably not fuIly realized assumptions underlying this strategy, inter alia concerning understanding of notion of culture, or "militant" ethnocentrism, by which criminal law can be characterized. It is also argued that consistent application of currently most common version of cultural defence will take effect in lesser legal protection provided to the members of cultural minorities. It justifies thesis, that cultural defence is often flawed with paradox of multicultural vulnerability. In consequence, it is stated that although there are arguments in favor of this strategy, in current most common shape it is flawed with few significant contradictions and presumably it would be more appropriate to narrow cultural defence to victimless crimes.
