Artykuł stanowi próbę wykładni art. 96 k.p.c. w kontekście statuowanego tym przepisem obowiązku działania pełnomocnika w wypadku śmierci strony albo utraty przez nią zdolności sądowej aż do czasu zawieszenia postępowania. Analiza funkcji omawianego przepisu wraz z orzecznictwem i literaturą prowadzi do wniosku, że zakres ustawowego upoważnienia pełnomocnika do działania po śmierci lub wygaśnięciu mocodawcy obejmuje jedynie wszystkie niezbędne czynności prowadzące do prawomocnego zawieszenia postępowania. Zezwolenie to obejmuje nie tylko obowiązek zawiadomienia sądu o zdarzeniu, które obliguje do zawieszenia postępowania ex officio, ale także zaskarżenia orzeczeń wydanych z naruszeniem tego obowiązku, jeżeli ich uprawomocnienie się mogłoby zagrozić uzasadnionym interesom następców prawnych zmarłej lub wygasłej strony. Ponadto, gdy śmierć strony lub utrata zdolności sądowej uzasadnia umorzenie postępowania bez jego uprzedniego zawieszenia, pełnomocnik winien działać do czasu prawomocnego umorzenia postępowania.

The article explores the issue of the meaning of the Article 96 of the Code of Civil Procedure which stipulates that despite of expiry of the power of attorney in the event of the death of the party or the loss of its capacity to be a party in the civil proceedings, the attorney shall continue its procedural activities until the proceedings are stayed. Analysis of the function of the provision in question along with relevant case-law and literature leads the author to conclusion that the scope of attorney’s statutory authorization to act after the death or expiry of its plenipotentiary includes only all necessary steps leading to a final stay of the proceedings. This authorization covers not only duty to notify the court of an event which obliges the court to stay the proceedings but also to appeal court’s decisions which does not comply with aforesaid court’s duties, if such decisions may endanger legitimate interests of the legal successors of deceased or otherwise expired parties). Exceptionally, where a parties death or loss of capacity to be a party may warrant termination of proceedings without its prior suspension, attorney shall act until the final discontinuance of the proceedings securing its proper termination.
