Małe zainteresowanie w obrębie prawa karnego zjawiskiem spekulacji rynkowej wiąże się ze zmianą ustroju gospodarczego z gospodarki centralnie sterowanej na model gospodarki rynkowej opartej na własności prywatnej. W związku ze swoistością ustroju gospodarczego opartego na modelu społecznej gospodarki rynkowej i jego odmiennością od klasycznych modeli liberalnych, interesującym wydaje się spojrzenie z jego perspektywy na zjawisko spekulacji rynkowej w odniesieniu do prawa karnego. Praca ta ma więc na celu przeanalizowanie zjawiska spekulacji rynkowej w kontekście konstytucyjnej zasady społecznej gospodarki rynkowej, dokonanie wartościowania zachowań spekulacyjnych, a następnie zbadanie rodzimych unormowań z zakresu prawa karnego, które, moim zdaniem, w bardzo ograniczonym zakresie mogą penalizować aktywność będącą przejawem działalności spekulacyjnej na rynku.

The low interest in the phenomenon of market speculation under criminal law is connected with the change of the economic model from centrally controlled to a model based on private property. Due to the nature of the economic system based on the model of the social market economy and its differences from the classical liberal models, it seems interesting to look from its perspective at the phenomenon of market speculation in relation to criminal law. The aim of this thesis is to analyse the phenomenon of market speculation in the context of the constitutional principle of the social market economy, make its valuation, and to examine the domestic regulations in the field of criminal law, which, in my opinion, penalises the behaviour of speculative activity on the market only to a limited extent.
