Celem opracowania jest zaprezentowanie regulacji prawnych, obowiązujących od 7 listopada 2019 r., dotyczących czynności podejmowanych przez sąd i strony postępowania cywilnego na etapie poprzedzającym rozprawę (tzw. organizacja postępowania). W pracy przedstawiono nowe, wprowadzone do procedury cywilnej instytucje, tj. posiedzenie przygotowawcze i plan rozprawy, służące w zamierzeniu projektodawców nowelizacji k.p.c., usprawnieniu i zwiększeniu efektywności postępowania. Opracowanie zawiera ponadto porównanie nowych regulacji w zakresie organizacji postępowania ze stanem prawnym obowiązującym przed wejściem w życie nowelizacji z 2019 r. i zaprezentowanie związku tych rozwiązań z jedną z naczelnych zasad postępowania cywilnego - zasadą koncentracji materiału procesowego. W tym kontekście, przybliżone zostały również zmiany dotyczące wnoszenia przez pozwanego odpowiedzi na pozew, która w aktualnym stanie prawnym jest co do zasady obligatoryjna oraz ograniczeń czasowych w przedstawianiu twierdzeń i dowodów. W opracowaniu zaprezentowano także bariery, mogące przyczynić się do występowania ograniczeń w stosowaniu nowych przepisów i przewidywane pozytywne aspekty wprowadzonych zmian.

The aim of the elaboration is to present the legal regulations in force since November 7, 2019, relating to actions taken by the court and parties to civil proceedings at the stage preceding the hearing (the so-called organization of proceedings). The master thesis presents new institutions introduced to the civil procedure, i.e. the preparatory meeting and the plan of the hearing, intended for the purpose of the drafters of the amendment to the Civil Procedure Code, as well as streamlining and increasing the effectiveness of the procedure.The elaboration also compares the new regulations on the organization of proceedings with the legal status in force before the entry into force of the 2019 amendment and presents the relationship between these solutions and one of the guiding principles of civil procedure - the principle of concentration of procedural material. In this context, the changes concerning the defendant's filing of the statement of defense, which in the current legal state is obligatory in principle, and the time limits in presenting statements and evidence were also presented. The elaboration also presents barriers that may contribute to the occurrence of limitations in the application of the new regulations and anticipated positive aspects of the introduced changes.
