Przedmiotem niniejszej pracy jest omówienie instytucji wydawania i prostowania świadectw pracy oraz katalogu roszczeń przysługujących pracownikowi na podstawie przepisów kodeksu pracy czy także kodeksu cywilnego. Dodatkowo w pracy zostały poruszone kwestie procedur dotyczących roszczeń związanych z wydawaniem świadectw pracy, które zostały wprowadzone do kodeksu postępowania cywilnego. Autorka pracy postawiła tezę, że obecne uregulowania dotyczące świadectw pracy są kompleksowe i nie wymagają dodatkowych uregulowań prawnych w przyszłości. W pracy oparto się na analizie dogmatycznej. Dla całościowego omówienia tematyki odniesiono się do przepisów prawa, stanowiska doktryny oraz orzecznictwa sądowego. Pracę podzielono na siedem rozdziałów. Pierwszy z nich zawiera omówienie charakteru prawnego świadectwa pracy. W rozdziale drugim wskazano na aspekt aksjologiczny omawianych regulacji, zwracając uwagę przede wszystkim na funkcji ochronnej prawa pracy. Rozdział trzeci zawiera historyczne ujęcie instytucji świadectwa pracy. Rozdział czwarty zawiera omówienie tematyki wydawania świadectwa pracy, natomiast rozdział piąty sprostowania świadectwa pracy. W rozdziale szóstym wskazano na inne roszczenia związane z wydawaniem świadectw pracy. Ostatni rozdział zawiera omówienie szczególnej procedury wprowadzonej do kodeksu postępowania cywilnego od 16 maja 2019 r. W konkluzji autorka stwierdziła, że na gruncie nowelizacji z 2019 r. zapełniono istotną lukę w systemie prawa powszechnie obowiązującego związaną z wydawaniem i prostowaniem świadectw pracy, jednakże uregulowania te wymagają doprecyzowania. W szczególności chodzi o doprecyzowanie zależności pomiędzy roszczeniem o sprostowanie świadectwa pracy, a roszczeniem o zobowiązanie pracodawcy do sprostowania świadectwa pracy.

The subject of this master thesis is to discuss the institution of issuing and rectifying work certificates and the catalogue of claims to which an employee is entitled on the basis of the provisions of the Labour Code or the Code of Civil Procedure. In addition, the paper discusses the procedures for claims related to the issuance of certificates of employment, which were introduced to the Code of Civil Procedure. The author of the thesis put forward a thesis that the current regulations concerning certificates of employment are comprehensive and do not require additional legal regulations in the future. The paper is based on a dogmatic analysis. For a comprehensive discussion of the subject matter, reference was made to the provisions of law, the position of doctrine and court rulings. The thesis was divided into seven chapters.The first one contains a discussion of the legal nature of the certificate of employment. The second chapter indicates the axiological aspect of the discussed regulations, paying attention primarily to the protective function of labour law. The third chapter contains the historical approach to the institution of the certificate of employment. The fourth chapter contains a discussion of the issue of the certificate of employment, while the fifth chapter contains a rectification of the certificate of employment. The sixth chapter indicates other claims related to the issuance of certificates of employment. The last chapter contains a discussion of a special procedure introduced to the Code of Civil Procedure from 16 May 2019. In the conclusion, the author stated that on the grounds of the amendment of 2019 a significant gap in the system of law related to the issuance and rectification of certificates of employment has been filled, but these regulations need to be clarified. In particular, the dependence between the claim to rectify the certificate of employment and the claim to oblige the employer to correct the certificate of employment has to be clarified.
