Celem pracy „Teatr jako podmiot prawa administracyjnego” jest ujęcie podmiotowości teatrów na gruncie prawa administracyjnego. Analizie zostaną poddane zarówno teatry działające w sektorze publicznym tj. teatry samorządowe i narodowe, jak również teatry funkcjonujące w ramach sektora społecznego i prywatnego.Z uwagi na wielość możliwych form organizacyjnych teatrów, praca ma charakter złożony i opiera się na różnych metodach badawczych. Pierwszy rozdział niniejszej pracy stanowi próbę przedstawienia procesu kształtowania się podmiotowości teatrów na ziemiach polskich w kontekście historycznym od XIII wieku aż do dnia dzisiejszego. Szczególnej analizie w tej części poddano teatry warszawskie. Dalsze rozdziały prezentują współczesną działalność teatrów jako publicznych i niepublicznych jednostek organizacyjnych. Do przesądzenia o przynależności określonej kategorii teatrów do danej grupy podmiotowej, wykorzystano metodę opartą na zaprezentowaniu definicji doktrynalnej każdego z analizowanych pojęć, a następnie sprawdzeniu czy wybrana grupa teatrów spełnia cechy definicyjne takiego podmiotu. W ramach publicznych jednostek organizacyjnych zwrócono uwagę na kwestię statusu teatrów jako zakładu administracyjnego, przedsiębiorstwa publicznego oraz korporacji, podkreślając jednocześnie dostrzeżoną hybrydowość tych podmiotów. Ponadto, zwrócono również uwagę na pojęcie instytucji kultury, a także jej związki z formą instytucji artystycznej. W zakresie tych rozważań dokonano równocześnie próby wyszczególnienia najważniejszych cech charakterystycznych teatrów, wynikających z ich ustawowej przynależności do kręgu tych instytucji oraz wpływu takiego uregulowania na aktualny kształt polskich teatrów instytucjonalnych. Z kolei na gruncie rozważań o podmiotowości teatrów jako niepublicznych jednostkach organizacyjnych szczególnej analizie poddano kwestię teatrów działających jako stowarzyszenia oraz fundacje.W niniejszej pracy, oprócz elementów czysto teoretycznych, zawarto także propozycje konkretnych rozwiązań dla dostrzeżonych problemów w ramach podmiotowego funkcjonowania współczesnych teatrów. Zamieszczono również szereg odniesień do praktycznego wymiaru tych instytucji, który wynika bezpośrednio z prawnej przynależności teatrów do danej kategorii podmiotów prawa administracyjnego. Do napisania pracy wykorzystano literaturę fachową głównie z zakresu prawa administracyjnego oraz historii teatru polskiego.

The dissertation entitled ‘Theatre as an administrative law entity’ aims to describe the subjectivity of theatres in the field of Polish administrative law. The analysis will comprise theatres belonging to the public sector i.e. local and national institutions as well as those falling within the social and private sector of the theatre industry. Due to numerous forms of theatre organisation as well as taking into account the complex nature of this study, multiple testing methods and approaches will be considered. The first chapter of the following paper attempts to introduce the historical context and describe the process of creation and shaping of theatres in the territory of Poland from the 13th century up until now. This section brings particular focus to the analysis of Varsovian theatres. Further chapters present the contemporary activity of theatres as public or private organisational units. The method used to judge the affiliation of a certain category of theatres to a given group of entities is based on introducing a doctrinal definition of each analysed criterion and thereafter verifying whether or not the characteristics of the chosen category coincide with those indicated in the definition. Regarding public organisational units, theatres have been analysed from the perspective of their status, considering them as administrative institutions, public enterprises or corporation companies, yet still acknowledging their hybridity in terms of these aspects. Furthermore, the concept of cultural institution and its relation to the structure of an art institution have also been highlighted. This analysis also includes simultaneous attempts to identify the most important characteristics of theatres being an immediate consequence of their statutory affiliation to the circle of these institutions as well as to distinguish the impact of such regulation on the current condition of Polish theatres. However, with regard to theatres as private organisational units, this dissertation focuses mainly on theatres operating as associations or charities. Besides purely theoretical elements of the research, this paper contains proposed solutions to observed problems concerning current functioning of theatres as well as includes multiple references to real-life activities of these institutions which directly result from the legal affiliation of theatres to a given category of the administrative law entities.The research has been carried out using professional literature from the field of Polish administrative law and history of Polish theatre.
