Przedmiotem rozważań zawartych w publikacji jest próba odpowiedzi na pytanie czy zlanie się stron procesowych w trakcie postępowania, określane mianem procesowej konfuzji, musi prowadzić bezwyjątkowo do umorzenia procesu, z uwagi na następczą niedopuszczalność wydania wyroku w rozumieniu art. 355 § 1 KPC. Po przeanalizowaniu istoty oraz przyczyn procesowej konfuzji oraz charakteru orzeczenia sądu w przedmiocie umorzenia postępowania, autor doszedł do wniosku, iż jeżeli zlanie się stron procesu ma charakter odwracalny (co zasadniczo może dotyczyć wyłącznie skutków sukcesji procesowej inter vivos, w trybie art. 192 pkt 3 KPC), a przywrócenie dwustronności postępowania nastąpi przed uprawomocnieniem się postanowienia umarzającego proces, to z uwagi na zasadę aktualności orzekania, dopuszczalne jest kontynuowanie postępowania w zmienionej konfiguracji podmiotowej.
The paper attempts to examine prevailing opinion that, under the Polish Code of Civil Procedure, procedural succession of one party in lieu of its opponent constitutes an impediment to civil proceedings which must always result in the issuance of judicial decision ordering mandatory discontinuance of the proceedings. In conclusion the author states that if the aforesaid merger of the role of plaintiff and defendant into one person proves reversible by the subsequent participation of a third party (which restores the bilateral structure of proceedings) before the decision on the discontinuation of proceedings becomes final, the proceedings may be lawfully continued and a judgment on the merits of a dispute may be given.
