Celem niniejszej glosy jest ocena rozstrzygnięcia zawartego w ww, uchwale Sądu Najwyższego odnośnie do wpływu umorzenia postępowania egzekucyjnego na wniosek wierzyciela na przerwę biegu przedawnienia spowodowaną złożeniem wniosku o wszczęcie tego postępowania. Ocena ta wymaga analizy dopuszczalności odpowiedniego zastosowania zawartej w art. 203 § 2 KPC normy regulującej konsekwencje skutecznego cofnięcia pozwu (tj. powodującego umorzenie postępowania), do umorzenia postępowania egzekucyjnego na wniosek wierzyciela (art. 825 pkt 1 KPC). Zgodnie ze zdaniem pierwszym art. 203 § 2 KPC pozew cofnięty nie wywołuje żadnych skutków jakie ustawa wiąże z wytoczeniem powództwa. Skutki te, stosownie do art. 123 § 1 pkt 1 KC, obejmują przerwanie biegu przedawnienia roszczenia. Szczegółowa analiza ww. kwestii (w tym w szczególności podobieństw i różnic pomiędzy cofnięciem pozwu a wnioskiem o umorzenie postępowania egzekucyjnego) doprowadziła do konkluzji o prawidłowości stanowiska zajętego w glosowanym orzeczeniu, a zatem że umorzenie postępowania egzekucyjnego na wniosek wierzyciela skutkuje całkowitym zniesieniem przerwy przedawnienia spowodowanej wszczęciem tego postępowania.
The purpose of this gloss is to evaluate decision of the Polish Supreme Court regarding the impact of the discontinuance of the enforcement proceedings based on the creditors’s request on the run of the limitation period interrupted by the submission of the creditor’s motion initiating these proceedings. The analysis involves the assessment of the admissibility of the corresponding application of the rule provided for in art. 203 § 2 of the Polish Code of Civil Procedure regarding the effects of the withdrawal of a compliant in civil proceedings leading to the discontinuance of the civil process to the discontinuance of enforcement proceedings based on a request of a creditor. Pursuant to the first sentence of art. 203 § 2 of the Polish CCP complaint which is withdrawn shall have none of the effects associated by relevant statutory provisions with the bringing of an action, which according to art. 123 § 1 point 1 of the Polish Civil Code includes interruption of the run of the limitation period. Detailed analysis of the abovementioned issue leads the author to a conclusion that a stance adopted in the commented judgment is correct, i.e. discontinuance of the enforcement proceedings due to a request of a creditor shall result in the total annulment of the interruption of the run of the limitation period caused by the commencement of the enforcement proceedings.
