Rozwój nowych technologii powoduje, że co jakiś czas odżywa dyskusja na temat prawnych aspektów kształtowania kultury. Zdaniem niektórych należy wprowadzać ograniczenia w swobodnym i niekontrolowanym dostępie do cudzej wiedzy oraz rezultatów pracy twórczej, mając na celu ochronę interesu autorów i producentów. Inni z kolei postulują nieskrępowany przepływ i korzystanie z dóbr intelektualnych sugerując, że tylko dzięki temu kultura ma szansę rozwoju. To drugie podejście nazywane jest koncepcją wolnościową lub opatrywane jest mianem „wolnej kultury”. Jego założeniem jest preferowanie idei dzielenia się przez twórców własnym dorobkiem intelektualnym, dobrowolne udostępnianie wypracowanych treści szerokim rzeszom użytkowników i nieskrępowane korzystanie z nich przez inne osoby. Wśród twórców i odbiorców dóbr kultury funkcjonują dwa ujęcia fenomenu „wolnej kultury”. pierwsze z nich wiąże tę wolność z dewizą: „wszystko można”, rezygnując w konsekwencji z poszanowania praw autorskich. Natomiast drugie wytycza granice wolności odwołując się do wartości etycznych i moralnych, a także „samoregulacji” tworzonej i akceptowanej przez samych zainteresowanych. Celem niniejszego referatu jest próba opisania i zdefiniowania koncepcji „wolnej kultury”, przede wszystkim w aspekcie adekwatnych rozwiązań prawnych, przy podkreśleniu różnorodności tego zjawiska. Przedmiotem zainteresowania jest wolność rozumiana jako kultura dzielenia się i jako usprawiedliwienie piractwa.
Rapid grow-up of new technologies cause that culture and its law aspects became a topic of discussion more often today. There is an opinion that uninhibited and uncontrolled access to creativity and others knowledge is not the right solution because this does not protect authors and producers interests. Contrary to that, others postulate to keep unfettered flow of information and unlimited access to intellectual properties as the only chance for culture development. The second approach is called the concept of "free culture". The main aim is to popularize idea of sharing the intellectual heritage by creators, the free access to content and unlimited using it by others. There are two kind of perception of “free culture” phenomenon. The first one recall the motto: "everything is allowed" also, as a consequence, not respecting of copyright. The second define limits of freedom by referring to ethical and moral values and “self-regulation” created and accepted by authors and users. The aim of this paper is an attempt to describe and define the concept of "free culture", mainly in terms of law regulations with highlighting the diversity of topic. The scope of article is freedom understood as a culture of sharing and an excuse for piracy.
