Niniejsza praca magisterska ma za zadanie analizę przepisów z zakresu ochrony danych osobowych obowiązujących w Unii Europejskiej oraz w Stanach Zjednoczonych Ameryki, z uwzględnieniem transferu danych z UE do USA. Pierwszy rozdział poświęcony jest tematyce regulacji unijnych, przede wszystkim dyrektywie 95/46/WE, a także ogólnemu rozporządzeniu o ochronie danych nr 2016/679. Omówiona jest także rola Trybunału Sprawiedliwości UE w interpretowaniu dyrektywy 95/46/WE oraz znaczeniu tego orzecznictwa, dla krajowych organów nadzorczych. Jako, że dyrektywa wymaga wdrożenia do krajowego porządku prawnego, poruszona zostaje także kwestia pozycja Generalnego Inspektora Ochrony Danych Osobowych i jego znaczenia dla przestrzegania przepisów z zakresu ochrony danych. Drugi rozdział jest poświęcony rozwiązaniom obowiązującym w Stanach Zjednoczonych, tak na poziomie federalnym, jak i stanowym. Na poziomie stanowym opisane są regulacje obowiązujące w stanie Kalifornia, który jest w dziedzinie ochrony danych krajowym pionierem. Poruszona zostaje także rola Federalnej Komisji Handlu, jako podmiotu będącego de facto organem nadzorczym z zakresu ochrony danych. Ostatni, trzeci rozdział jest dedykowany transferowi danych z UE do USA w kontekście unijnych przepisów, a w konsekwencji o unieważnione przez Trybunał Sprawiedliwości porozumienie Safe Harbor oraz obecnie negocjowane porozumienie Privacy Shield.

This thesis is focused on the issue of the data protection legal systems functioning, both in the European Union and in the United States of America including the problem of transfer of data from the EU to the US. The first chapter is devoted to the EU system with special focus on directive 95/46/EC as well as the new general data protection regulation (n°2016/679). Furthermore, the case law of the Court of Justice of the European Union is analyzed and its impact on the functioning of the national supervisory authority. The implementation of the directive is brought under consideration with the example of Polish legal solutions for the supervisory authority and its institutional position. Second chapter deals with the US legal system on both federal and state legislature in the field of data protection. The state of California has been chosen as a model representative of progressive solutions concerning data protection. In addition, the role of the Federal Trade Commission has been discussed as a de facto federal data protection regulator. The last chapter focuses on the data transfer from the EU to the US in the light of EU regulations, specifically the Safe Harbor agreement which was declared void by the CJEU and the newly negotiated Privacy Shield which is about to replace the Safe Harbor.
