Subsidiarity of the constitutional complaint in Poland

Praca omawia zasadę subsydiarności, która jest jedną z przesłanek do wniesienia skargi konstytucyjnej. Wskazuje przedmiot i podmiot oraz cel, któremu służy skarga konstytucyjna jak i jej tryb wnoszenia do Trybunału Konstytucyjnego. Praca zwraca uwagę na założenia wyżej wspomnianej zasady subsydiarności i sposób jej działania. Zawiera analizę poszczególnych postępowań - karnego, cywilnego i administracyjnego, która pozwala dokładnie zinterpretować pojęcie „ostateczności”, które jest nieodzownym elementem zasady subsydiarności.

The thesis discusses the principle of subsidiarity, which is one of the premises for bringing a constitutional complaint. It indicates the subject and object, and the purpose of the constitutional complaint and its procedure of bringing to the Constitutional Tribunal. It draws attention to the assumptions of the principle of subsidiarity mentioned above and the way it works. It contains an analysis of each of the proceedings - criminal, civil and administrative, which can accurately interpret the concept of "finality", which is an indispensable element of the principle of subsidiarity.
