Niniejsza praca ma na celu przedstawienie problematyki dowodu z opinii biegłego. Część pierwsza skupia się przede wszystkim na przybliżeniu podstawowych pojęć z zakresu prawa dowodowego. W części drugiej przedstawiono dwie zasady procesowe rządzące prawem dowodowym – legalną oraz swobodną ocenę dowodów. Część trzecia skupia się wokół osoby biegłego i związanych z tym takimi zagadnieniami jak: rodzaje biegłych i przesłanki ich powołania, wymogi stawiane biegłym, zakazy dowodowe oraz prawa i obowiązki biegłych. Część czwarta poświęcona została najważniejszemu zagadnieniu, czyli opinii biegłego. Przedstawiono przede wszystkim sposób wprowadzenia opinii do procesu, jej formę i zakres. Omówiono zasady oceny opinii przez sąd i związane z nimi problemy, tj. wady opinii, jej niezastępowalność innymi dowodami oraz związanie sądu jej treścią. Ponadto odniesiono się do możliwości występowania opinii w postępowaniu odwoławczym. Dużą część pracy stanowią rozważania dot. opinii prywatnej. Próbowano w nich odpowiedzieć na pytania o jej charakter prawny, rzetelność oraz przydatność dla procesu w kontekście zasady równości broni. Integralną częścią pracy są badania aktowe przeprowadzone na grupie 211 akt spraw z lat 2009-2014. Ich głównym celem było zweryfikowanie tezy, czy sądy są związane opinią biegłego oraz określenie jakie czynniki wpływają na powołanie biegłego.
The aim of this work is to present some important issues connected with expert evidence. The first part focuses mainly on explaining basic terms from the field of evidence law. The second part presents two significant rules of evidence law during the lawsuit. These are the legal and the free appraisal of evidence. The third part concentrates on the person of expert witness and such matters as types of expert witnesses, the reasons for choosing and appointing them, requirements for them, evidential prohibitions and the rights and duties of expert witnesses. The fourth part is devoted to the most important matter which is the expert witness' opinion. It shows the way of introducing the opinion during the lawsuit, its form and range. This part discusses the rules of assessment of the opinion and the problems which can influence these rules. These problems may be opinion's disadvantages, lack of possibility to substitute the opinion with other evidence, or the impact if its contest on the court. What is more, this part deals with the possibility to use the opinion in the case of appeal. A large part of this paper is dedicated to considerations about the private opinion. It tries to answer the questions about the legal nature of the opinion, its reliability and usefulness for the lawsuit according to the principle of equality of arms. The paper is integrated with files examination which was held on the group of 211 case files from 2009 to 2014. The goal of that examination was to verify the thesis whether the courts are bound with the opinion of expert witness and to define which factors influence choosing and appointing the expert witnesses.
