Streszczenie.Głównym celem pracy było przedstawienie problematyki możliwości wypowiedzenia stosunku pracy pracownikowi podlegającemu szczególnej ochronie, ze względu na wiek ostatecznie determinujący jego uprawnienia emerytalne.Praca składa się z trzech części. W pierwszej z nich wskazano na przyczyny ochrony trwałości zatrudnienia w ogóle, oraz na tle obowiązujących przepisów krajowych i międzynarodowych, nawiązując równocześnie do zjawiska ochrony godności ludzkiej. Ponadto wskazano metody i środki ochrony trwałości zatrudnienia, oraz uwzględniono podział ochrony na powszechną i szczególną.Druga część poświęcona jest analizie systemu emerytalnego w Polsce z uwzględnieniem obowiązujących przepisów i różnorodności konstrukcji emerytalnych w odniesieniu do wieku przedemerytalnego i emerytalnego.Trzecia, zasadnicza część, polega na analizie przepisów dotyczących ochrony pracowników w wieku przedemerytalnym, wskazujących długość okresu ochronnego. Ponadto praca zawiera odwołanie do przypadków zasadności wypowiedzenia stosunku pracy, mimo osiągnięcia wieku przedemerytalnego. Poruszony został także temat zakazu dyskryminacji ze względu na wiek lub płeć w zatrudnieniu, oraz wskazano na uprawnienia pracownika w wieku przedemerytalnym w razie wypowiedzenia umowy o pracę.

"Protecting employment stability of workers close to retirement age." Abstract.The main aim of this work was to present the issue of the possibility of termination of employment relationship governed by the special protection because of their age eventually determinding his pension rights.The work consists of three parts. In the first of them pointed out the reasons for the protection of sustainable employment in general, and against the background of existing national and international regulations, while referring to the phenomenon of human dignity. They state the methods and measures to protect employment stability and security division includes universal and the particular.The second part is devoted to the analysis of the pension system in Poland, taking into account existing legislation and the diversity of pension structures in relation to the age of retirement and retirement.Third, the main part is to analyze the provisions on the protection of workers approaching retirement age, indicating the length of the guard. In addition, the work contains a reference to cases where the legitimacy of dismissal, despite reaching the age of retirement. It was also touched on the prohibition of discrimination on grounds of age or gender in employment, and pointed out the employee's entitlement to retirement in the event of termination of employment.
