Miejscowy plan zagospodarowania przestrzennego - zasada fakultatywności w jego stanowieniu

Celem działania organów administracji publicznej w zakresie planowania przestrzennego jest uzyskanie racjonalnie zagospodarowanej przestrzeni, uwzględniającej wszelkie wymagania funkcjonalne, społeczne, gospodarcze, środowiskowe, kulturowe i estetyczne, pozwalające na optymalne zaspokojenie bieżących oraz przyszłych potrzeb społeczności. Narzędziem służącym realizacji tego celu są akty planowania przestrzennego, dotyczące przeznaczenia, zasad zagospodarowania i zabudowy terenu oraz rozmieszczenia na nim inwestycji celu publicznego. Stanowiony przez organy samorządu terytorialnego gminy miejscowy plan zagospodarowania przestrzennego stanowi podstawę aktów systemu planowania. Zajmuje wśród nich miejsce szczególne; posiada status aktu prawa miejscowego, jest wiążący dla wszelkich instytucji publicznych, prywatnych oraz właścicieli nieruchomości. Zgodnie z przyjętym rozwiązaniem, ujętym zapisami u.p.z.p., obowiązuje zasada fakultatywności w stanowieniu planu miejscowego; uchwalenie go zależy od decyzji rady gminy. Ustawodawca przewiduje wyjątki od tej zasady, wyraźnie określone w ustawie, kiedy plan miejscowy jest sporządzany obligatoryjnie. Obowiązek taki wynikać może z przepisów odrębnych, z zapisów studium uwarunkowań i kierunków zagospodarowania przestrzennego gminy oraz z zaniechania rady gminy. Fakt, że miejscowy plan zagospodarowania przestrzennego jako jedyny dokument wśród aktów kształtujących ład przestrzenny jest aktem prawa powszechnie obowiązującym, świadczy o jego szczególnej pozycji w polskim systemie planowania przestrzennego.
The aim of public administration authorities in the process of spatial planning is to ensure rationally developed space taking into consideration all functional, social, economic, environmental, cultural and aesthetic requirements enabling the optimum satisfaction of the current and future needs of the local community. What serves as a tool for the achievement of that goal is a group of spatial planning acts concerning the intended purpose of the land and the rules for land development and for the location of public purpose projects on such land. The local spatial development plan adopted by the local communal government bodies is the basis for planning system acts. It has a special place among them; it enjoys the status of a planning law act, is binding upon any public and private institutions and upon property owners. According to the adopted solution contained in the provisions of the Spatial Planning and Development Act, the adoption of a local plan is governed by the optionality principle; the adoption of the plan depends on a decision of the communal council. The legislator provides for certain exceptions from that principle, expressly specified in the Act, when the preparation of the local plan is obligatory. Such obligation may arise from separate laws, the provisions of the study on the commune spatial development conditions and tendencies and from the communal council’s omission. The fact that among various documents shaping the spatial order the local spatial development plan is the only one that is a generally applicable law indicates its special position in the Polish spatial planning system.
