Tematem pracy jest charakterystyka środka prawnego, jakim jest skarga na uchwały i zarządzenia organów gminy, podejmowane w sprawach z zakresu administracji publicznej, naruszające interes prawny lub uprawnienie podmiotów pozostających poza strukturą tych organów, uregulowana w artykule 101 ustawy o samorządzie gminnym. Jest to najpowszechniejszy, najczęściej wykorzystywany ze środków prawnych przysługujących na akty wydawane przez organy gminy. Pozwala on skarżącym na uruchomienie przed sądem administracyjnym postępowania, którego celem jest weryfikacja i ewentualne wyeliminowanie z obrotu prawnego aktów naruszających ich interesy prawne lub uprawnienia, a jednocześnie, stanowi on dla organów gminy ograniczenie możliwości działania niejako poza obowiązującym prawem. W związku z tym, przedmiotem tej rozprawy jest omówienie skargi poprzez analizę jej najważniejszych elementów oraz ocena sposobu uregulowań zawartych w ustawie – Prawo o postępowaniu przed sądami administracyjnymi oraz ustawie o samorządzie gminnym. Praca została podzielona na cztery części.W pierwszym rozdziale omówiona została trudna, budząca najwięcej wątpliwości w doktrynie kwestia zakresu przedmiotowego skargi. Podjęta została próba ustalenia katalogu spraw, które mogą zostać zaskarżone w omawianym trybie, w szczególności poprzez analizę pojęcia „sprawy z zakresu administracji publicznej”. Aby podkreślić, że są to akty o różnym charakterze, dotyczące zróżnicowanej materii, a zarazem dokonać możliwie dokładnej analizy, podano przykłady uchwał i zarządzeń podlegających zaskarżeniu oraz nienależących do zakresu administracji publicznej.Drugi rozdział pracy dotyczy legitymacji do wniesienia skargi. W pierwszej kolejności wskazane i scharakteryzowane zostały przesłanki tej legitymacji – posiadanie interesu prawnego bądź uprawnienia oraz jego faktyczne naruszenie. Pojęcie „interesu prawnego” zostało poddane dokładnej analizie, określono jego charakter oraz odróżniono je od pojęcia „interesu faktycznego”. Następnie, krótko opisano kwestię interesu prawnego w związku ze zgodnością z prawem zaskarżanego aktu. Ostatnia część tego rozdziału poświęcona została możliwości wniesienia skargi do sądu w imieniu mieszkańców gminy, za ich pisemną zgodą. Jest to szczególny rodzaj współuczestnictwa podmiotów w postępowaniu administracyjnym.W trzecim rozdziale analizie poddane zostały formalne przesłanki dopuszczalności skargi. Kolejno dokonano ich charakterystyki. Pierwszą przesłankę stanowi bezskuteczne wezwanie organu do usunięcia naruszenia – w tym miejscu poruszono kwestie nieuregulowane wprost w przepisach, a więc w jakim terminie powinno zostać ono wniesione i jaki czas przysługuje organowi na odpowiedź oraz kto powinien być adresatem tego wezwania. Następnie omówiono instytucję sprawy osądzonej. Jej istotą jest to, że skarga nie może być wniesiona, jeżeli w sprawie orzekał już sąd administracyjny i skargę oddalił. Podkreślono, że zakaz ten odnosi się zarówno do wezwania do usunięcia naruszenia interesu prawnego, jak i do możliwości zaskarżenia danej uchwały czy zarządzenia. Na końcu poruszono kwestię zachowania terminu do wniesienia skargi. W ostatnim, czwartym rozdziale zdefiniowano, jaki charakter ma omawiana skarga. Podkreślono, że nie jest ona aktem nadzoru nad działalnością gminną, a środkiem prawnym, który służy do ochrony jednostek przed bezprawną działalnością gminy. Ustalono także, że omawiana skarga nie stanowi środka o charakterze actio popularis. W końcowej części rozdziału zawarte zostały rozważania dotyczące suspensywności skargi.Zakończenie niniejszej rozprawy zawiera ocenę uregulowań dotyczących skargi z artykułu 101 ustawy o samorządzie gminnym. Negatywnie odniesiono się do rozrzucenia oraz braku ujednolicenia przepisów ustawy o samorządzie gminnym z ustawą– Prawo o postępowaniu przed sądami administracyjnymi, a także do użycia przez ustawodawcę pojęć niedookreślonych. Pozytywnie oceniono natomiast szeroki zakres podmiotowy i przedmiotowy skargi.
The subject of this thesis is characterization of a charge which is regulated in an article 101 of Ustawa o samorządzie gminnym. This charge can be brought to the administrative court against the resolution passed by the authorities of a commune if the resolution is related to the issues from the field of public administration and violates legal interest or right of entities. It is the most popular, the most frequently used kind of charge that can be brought to the administrative court against the resolutions of authorities of a commune. It allows complainants to initiate judicial proceeding before the administrative court in order to verify and possibly eliminate from the legal transactions resolutions that violate other's rights and at the same time it is a legal measure which restricts the possibilities that the authorities will act beyond the law. With regard to this, the topic of this thesis is to characterize the charge by analysing its essentials and to judge the method of its regulation in the law.In the first chapter, the difficult and complicated issue of objective scope of the charge, which is often discussed and questioned in doctrine, is presented. It is an attemption to establish the catalogue of the issues (acts, resolutions) against which the discussed charge can be brought, especially by analysing the concept of an issue from the field of public administration. To emphasise the variety of the resolutions' characters and matters they are related to and, simultaneously, to make the analyse more precise, examples are presented.The second chapter is about the legitimation to complaint and initiate the proceeding before the administrative court. Firstly, circumstances and indications of legitimation – having a legal interest and violation of this interest, are characterized. The concept of legal interest is precisely analysed and distinguished from actual interest. Then, the relation between the legal interest and the act's accordance with the law is shortly described. The last part of this chapter describes the possibility to bring an action to the court on behalf of the community's citizens, by their written consent. It is a special kind of participation of the entities in the administrative proceeding.The third chapter is an analysis of the formal indications of admissibility of the charge. The first circumstance is ineffective summons to eliminate the violation – matters which are not directly regulated in law, such as when to file the summons, who should be its addressee and how much time do the authorities have to answer it, are described. Then the concept of res iudicata is characterized. Its essence is that the charge cannot be bring if the administrative court have already ruled in the same case and dismissed the charge. The prohibition regards both the summons to eliminate the violation and the possibility to bring an action against resolution. At the end, the issue of bringing the charge to the court in due time is raised.In the last, fourth chapter the character of the charge is defined. It is emphasised that it is not an act of supervision of municipal bodies but the legal measure which serves to protect entities from illegal activity of authorities. It is also established that this charge is not an actio popularis. Despite having some features which suggest that, the possibility to bring this charge to the court is not unrestricted and individuals have to meet some requirements to have the legitimation to complain. The final part is a consideration about the suspension of the charge.The ending of this thesis contains an opinion of the way the charge is regulated in law. Scattering of regulations and lack of uniformity in law, as well as using the undefined terms deserves the negative opinion. On the other hand, wide range of both objective and subjective scope has to be judged positively.
dc.abstract.en | The subject of this thesis is characterization of a charge which is regulated in an article 101 of Ustawa o samorządzie gminnym. This charge can be brought to the administrative court against the resolution passed by the authorities of a commune if the resolution is related to the issues from the field of public administration and violates legal interest or right of entities. It is the most popular, the most frequently used kind of charge that can be brought to the administrative court against the resolutions of authorities of a commune. It allows complainants to initiate judicial proceeding before the administrative court in order to verify and possibly eliminate from the legal transactions resolutions that violate other's rights and at the same time it is a legal measure which restricts the possibilities that the authorities will act beyond the law. With regard to this, the topic of this thesis is to characterize the charge by analysing its essentials and to judge the method of its regulation in the law.In the first chapter, the difficult and complicated issue of objective scope of the charge, which is often discussed and questioned in doctrine, is presented.
